May problema ka ba sa developer ng property na binili mo?
Hindi sapat ang basta reklamo lang. Kailangan tama ang proseso para mas maging maayos at mas paborable ang maging resulta ng iyong complaint.

Narito ang mga dapat mong gawin:

1. Alamin muna kung may legal na batayan ang iyong reklamo.
Maaaring pumasok ang isyu sa alinman sa mga sumusunod:

A. Paglabag sa Presidential Decree No. 957, tulad ng:

👉Selling of subdivision lots/condominium units without a license to sell
👉Mortgage of title without clearance
👉Failure to provide facilities advertised
👉Non-development
👉Incomplete Development
👉Unauthorized alteration of plan
👉Non-delivery of title
👉Collection of real estate tax prior to buyer's occupation (
👉Unauthorized collection of dues by project owner/developer
👉Illegal use of open spaces

B. Paglabag sa RA 6552 o Maceda Law, tulad ng:

👉Cancellation of contract without factual basis
👉Cancellation of contract without complying with grace period or
notice requirements
👉Failure to refund cash surrender value

C. Paglabag sa mga partikular na obligasyon sa kontrata
Ito ay kapag may malinaw na obligasyon ang developer sa Contract to Sell, Deed of Sale, o iba pang kasunduan ngunit hindi nila ito tinupad. Halimbawa:

👉Hindi naturn-over sa napagkasunduang panahon ang property
👉Hindi naisagawa ang ipinangakong development o specifications
👉May singil o kondisyon na wala naman sa kontrata
👉Hindi natupad ang anumang malinaw na pangako o obligasyon ng developer sa inyong kasunduan

2. Mag-ipon ng documentary evidence.
Kolektahin ang lahat ng ebidensya na may kaugnayan sa reklamo, tulad ng:

👉Contract to Sell / Deed of Sale
👉Official receipts
👉Statements of account
👉Demand letters
👉Photos o videos
👉Screenshots ng usapan
👉Email correspondence
👉Project advertisements, brochures, o sample plans

3. Iwasan ang puro verbal na reklamo.
Siguraduhing documented ang lahat ng iyong reklamo. Maaari itong gawin sa pamamagitan ng:

👉Sulat na ipinapa-receive sa admin o opisina ng developer
👉Email
👉Official social media page o channel ng developer

Mahalaga na may kopya ka ng lahat ng ipinadala mong reklamo, pati na rin ng proof of receipt, screenshots, o reply ng developer.

4. Kung walang maayos na tugon ang developer, magpadala ng demand letter.
Kung hindi sila sumasagot o hindi ka nasisiyahan sa kanilang aksyon, magsumite ng formal demand letter. Ilahad nang malinaw ang:

👉Iyong reklamo
👉Legal o contractual basis ng reklamo
👉Hinihingi mong aksyon o remedyo
👉Palugit o deadline kung kailan mo inaasahan ang kanilang pagtugon

5. Kung wala pa ring nangyari, dumulog sa HSAC.
Kung hindi pa rin naaaksyunan ang iyong reklamo, maaari kang magsampa ng verified complaint sa Human Settlements Adjudication Commission (HSAC). Bisitahin ang official website ng HSAC para sa step-by-step process ng pag-file ng complaint. Mas mainam din na kumonsulta muna sa abogado upang magkaroon ka ng tamang legal guidance bago magsampa ng kaso.

‼️Paalala:‼️

👉Sa kabila ng iyong reklamo, huwag basta-bastang ihihinto ang pagbabayad ng monthly amortization sa developer. Kahit may reklamo ka, ang hindi pagbabayad ay maaari pa ring maging ground para sabihing ikaw naman ang nag-breach ng kontrata. Mas mabuting hintayin ang tamang legal na proseso at ang magiging desisyon ng HSAC bago gumawa ng anumang karagdagang aksyon.
