Some years back I was engaged to verify and authenticate the CCT of a condo ground commercial unit with matching Certified True Copies officially issued by the Taguig RD.

Except for names and addresses of Seller (Previous Registered Owner) and new Owner (Buyer) all details of the CCTs in the Buyer's Name and Seller's previous CCT were identically the same including the blank Accountable Form Serial Number, which should not be.

I was able to prove that the CCT issued by the RD of Taguig as SPURIOUS. Seller was completely unaware that the derivative Condo Certificate of Title issued to the New Owner (Buyer) was spurious.

Through court proceedings the New Owner (Buyer) was able to get the authentic CCT.

Specific CCT details have been blocked off to protect the identity of my clients (Buyer and Seller).

LRA recommended that the RD be criminally charged with the Office of the Ombudsman.

some real estate service practitioners will soon receive “Notarial Notices and Demand” for multiple violations of provisions of the Data Privacy Act of 2012 (RA 10173) – more specifically, for illegally accessing and disseminating private property data and publicly disseminating and advertising private property without prior consent from the owner and other violations – a serious criminal act.

if proven guilty of said offenses, RESP violators of the provisions of RA 10173 are liable to pay hefty fines and face possible imprisonment..

WARNING TO ALL REAL ESTATE BROKERS !!!

Make sure that you are authorized by a property owner (1) "To Offer To Sell/Lease out" or "To Negotiate for the Sale/Lease" a property and more importantly (2) that your “Authority” specifically permits and authorizes you “To Advertise" a listing, more so if the subject property is the subject of an ongoing judicial proceeding.

I am informed by engaged legal counsel in my capacity as "Atty-In-Fact" for a client that legal proceedings will soon be commenced against “a PRC licensed real estate broker and "’others’" that caused the illegal and unauthorized dissemination and publication thru electronic means of "certain property details" for culpable violation of "Data Privacy Act" and "Electronic Commerce Act of 2000" for advertising a property in a multi-listing service without authority and consent from a property owner.

I am informed that this case might be a “sui generis” case to be instituted against an erring real estate service practitioner and multi-listing group.
