❗️ ENCUMBRANCES SA LAND TITLE: ANONG DAPAT I-CHECK NG BUYERS BAGO MAGBAYAD?

Maraming buyers ang tumitingin lang sa front page ng Title at sa name ng owner.
But the real risk is usually hidden on the back page!

Ang Encumbrances or Annotations Section ay pwedeng mag-reveal ng mga claims, restrictions, o legal obligations na nakakabit sa property.

ANO ANG IBIG SABIHIN NG ENCUMBRANCE?

βœ… Any lien, claim, charge, restriction, o legal burden na nakakabit sa lupa.

βœ… Pwede nitong i-limit ang full rights ng owner o ma-affect kung paano mai-transfer ang property sa pangalan mo.

βœ… Usually nakasulat ito bilang annotation sa title record na hawak ng Registry of Deeds (RD).

BAKIT ITO IMPORTANT SA MGA BUYERS?

* Pwedeng ma-block o ma-delay ang sale at transfer ng Title.

* Pwedeng magbigay ito ng legal right sa ibang tao over the property.

* Pwedeng mag-create ito ng financial obligations (utang) na nakakabit sa lupa.

* Pwedeng i-restrict kung ano ang pwede mong itayo o kung paano mo gagamitin ang lupa.

* Kapag in-ignore mo ito, ikaw ang mag-i-inherit ng problema pagkabili mo!

COMMON ENCUMBRANCES NA PWEDE MONG MAKITA:

* Real Estate Mortgage – Ginawang collateral sa loan ang property at pwedeng ma-foreclose kapag hindi nabayaran.

* Levy on Ex*****on – Pwedeng ibenta ang property para pambayad sa court judgment.

* Lis Pendens – May pending court case na kinakasangkutan ang property.

* Easement / Right of Way – May legal right ang ibang tao na dumaan sa bahagi ng lupa mo.

* Deed or Subdivision Restrictions – Mga usage rules tulad ng residential use lang o height limit sa ipapapatayong bahay.

* Adverse Claim – May ibang taong nag-a-assert ng interest o karapatan sa lupa kahit hindi sila ang registered owner.

SAAN ITO DAPAT TINGNAN?

* Sa Encumbrances or Annotations Section, usually nasa likod o last page ng Title.

* Kumuha ng Certified True Copy (CTC) mula sa Registry of Deeds, dahil ito ang updated government record.

PRACTICAL BUYER CHECKLIST:

1️⃣ Get a Certified True Copy (CTC) of the Title directly from the Registry of Deeds.
Huwag mag-rely sa photocopy lang ng seller!

2️⃣ Read every annotation at i-confirm kung may proper Cancellation Entry ang alinmang mortgage o lien kung sinabing fully paid na ito.

3️⃣ Treat any Lis Pendens or Adverse Claim as a STOP SIGN hanggang hindi ito na-re-review ng eksperto.

4️⃣ Have a qualified professional review the Title and the Deed before signing anything or releasing payments.
