Yes — but it needs to be done properly.

Sometimes, homeowners need to sell a property even though they’re still paying a bank or Pag-IBIG loan due to financial difficulties, relocation, family emergencies, or other reasons.

This is commonly called a “pasalo” or Sale with Assumption of Mortgage.

🏠 𝗛𝗼𝘄 𝗗𝗼𝗲𝘀 𝗜𝘁 𝗪𝗼𝗿𝗸?

The buyer takes over the remaining loan balance and pays the seller for the equity already built into the property.

It can be a good opportunity — but there’s one important rule:

⚠️ 𝗔𝗹𝘄𝗮𝘆𝘀 𝗴𝗲𝘁 𝘁𝗵𝗲 𝗹𝗲𝗻𝗱𝗲𝗿’𝘀 𝗮𝗽𝗽𝗿𝗼𝘃𝗮𝗹.

A private or notarized agreement between the buyer and seller does not automatically transfer the loan or ownership.

⁉️ What Happens If Your Certificate of Title Has a Missing Page?

A Philippine land title—whether a TCT or OCT—may contain multiple pages. The succeeding pages often contain important annotations and encumbrances, such as mortgages, adverse claims, liens, and court orders.

So, if a page is missing, don’t ignore it.

⚠️ Why Is a Missing Page a Serious Concern?

If the missing page contains the title's annotations, you may be unaware of an existing mortgage, adverse claim, or lis pendens. A clean-looking first page does not necessarily mean the property is free from encumbrances.

✅ What Should You Do?

1. Get a Certified True Copy (CTC).
Request a CTC from the Registry of Deeds (RD) to verify the complete title and all annotations.

2. Compare it with your owner's duplicate.
Check if the missing page appears in the RD's official copy.

3. If the RD copy is also incomplete, seek legal assistance.
Depending on the circumstances, reconstitution or replacement of the title may be necessary under the applicable laws.

4. Consult a real estate lawyer if you're preparing to sell, buy, or mortgage the property.

🏆 Remember: A missing page does not automatically invalidate your title, but it can hide important information that may affect the property.

⚠️ Can You Sell a Property Using Only a Photocopy of the Certificate of Title?

The short answer is yes—but with significant legal risks.

A Deed of Sale may be signed based on a photocopy of the title, but ownership cannot be legally transferred without the original Owner's Duplicate Certificate of Title. Under the Property Registration Decree (Presidential Decree No. 1529), the original owner's duplicate must be surrendered to the Registry of Deeds before a transfer can be registered.

Without the original title, government agencies such as the BIR, Registry of Deeds, Assessor's Office, and Treasurer's Office cannot complete the transfer process.

🚩 If a seller can only present a photocopy of the title, treat it as a red flag. The property may be mortgaged, the seller may not be the registered owner, or there could be other legal issues affecting the property.

✅ Before making any payment, always verify the following:

The original Owner's Duplicate Certificate of Title
Proof that the seller is the registered owner, or a valid Special Power of Attorney (SPA) or Authority to Sell
A Certified True Copy (CTC) from the Registry of Deeds to verify the title's status and check for any mortgages, liens, or adverse claims

Remember: A buyer who pays without verifying these documents risks losing both the property and their money.
