Ang amilyar (mula sa Kastilang kintal o amillaramiento, at kilala rin sa Ingles bilang Real Property Tax o RPT) ay ang buwis sa ari-arian o lupain na ipinapataw ng lokal na pamahalaan (LGU) sa Pilipinas.

Ito ay taunang buwis na kailangang bayaran ng mga may-ari ng:

๐Ÿ”‘Lupa (residential, commercial, agricultural, o industrial)

๐Ÿ”‘Bahay o Gusali (residential o commercial buildings)

๐Ÿ”‘Makinarya (mga kagamitang nakakabit sa lupa o gusali para sa negosyo)

๐Ÿ“Sino ang nagpapataw? Ang City o Municipal Treasurer's Office kung saan matatagpuan ang ari-arian.

๐Ÿ“Kailan binabayaran? Taon-taon (pwedeng minsanang bayad sa Enero 31 o hulugan kada quarter: Marso 31, Hunyo 30, Setyembre 30, at Disyembre 31).

๐Ÿ“May discount ba? Oo! Karaniwang nagbibigay ang mga LGU ng 10% hanggang 20% discount kapag nagbayad nang maaga (early payment).

๐Ÿ“Ano ang parusa sa huli? May interes o penalty na 2% bawat buwan na delay (hanggang maximum na 72% o 36 na buwan).

Paano Ito Kinukwenta?
Hindi ito ibinabase sa mismong presyo kung presyo sa merkado (market value) kapag ibinebenta ang ari-arian, kundi sa Assessed Value nito.

Amilyar=Assessed Valueร—RPT Rate
Assessed Value: Fair Market Value ร— Assessment Level (depende sa uri ng property tulad ng residential o commercial).

RPT Rate:

Hanggang 1% para sa mga probinsya (provinces).

Hanggang 2% para sa mga lungsod (cities) at mga munisipalidad sa Metro Manila.

๐—ฃ๐—ฒ๐—ป๐—ฎ๐—น๐˜๐—ถ๐—ฒ๐˜€

Sa ilalim ng Local Government Code of 1991 (Republic Act No. 7160) sa Pilipinas, ang penalty o parusa kapag hindi nabayaran ang amilyar (Real Property Tax / RPT) sa tamang oras ay ang mga sumusunod:

1. Interes sa Pagkakaantala (Interest Rate)
2% bawat buwan: Ang penalty ay 2% interes kada buwan batay sa kabuuang halaga ng hindi nabayarang buwis.

Maximum Limit (36 Buwan / 72%): May limitasyon ang interes. May saklaw man ito nang higit sa tatlong taon, mag-iipon lamang ang interes hanggang 36 buwan (3 taon). Ang pinakamataas na pwedeng ipataw na interes ay 72% ng kabuuang utang sa buwis.

Halimbawa: Kung ang amilyar mo ngayong taon ay โ‚ฑ10,000 at na-late ka ng 5 buwan sa pagbabayad:

Penalty=โ‚ฑ10,000ร—2%ร—5 buwan=โ‚ฑ1,000
Kabuuang babayaran: โ‚ฑ11,000

2. Surcharge (Depende sa LGU)
Bukas din sa ilang lungsod o munisipalidad ang pagpataw ng hiwalay na Local Tax Surcharge (karaniwang 25% ng kabuuang unpaid tax) batay sa ipinasang Revenue Code ng lokal na pamahalaan.

3. Mas Mabigat na Hakbang sa Pagkabigo sa Pagbabayad (Delinquency)

Kapag nagpatuloy ang hindi pagbabayad ng amilyar pagkatapos ng mahabang panahon, may legal na kapangyarihan ang City o Municipal Treasurer's Office na gawin ang mga sumusunod:

Notice of Delinquency: Pagpapadala ng opisyal na babala at pagpo-post ng pangalan o listahan ng mga may ari-ariang hindi nagbabayad sa public places/barangay halls.

Warrant of Levy: Paglalagay ng opisyal na tax lien o kaaukulang utang sa pamagat (title) ng iyong lupa o bahay. Hindi mo ito maibebenta o maipapamana nang hindi muna nababayaran ang lahat ng arrears.

Public Auction (Paghahabol at Pag-subasta): Maaaring ihain sa public auction ang ari-arian upang maibenta sa pinakamataas na bidder para mabayaran ang nagkakautang na buwis at penalty.

May Pagkakataon pa bang Makaligtas sa Penalty?
Tax Amnesty: Paminsan-minsan, ang mga LGU (tulad ng Manila, Quezon City, Makati, atbp.) ay nagpapasa ng ordinansa para sa Real Property Tax Amnesty. Sa ilalim nito, pwedeng tanggalin (waive) ang 100% ng mga interes at penalty kapag binayaran nang buo ang pangunahing utang sa buwis.

Early Payment Discounts: Kung magbabayad nang mas maaga sa takdang panahon (karaniwang bago matapos ang Disyembre o Enero), nakakakuha ng 10% hanggang 20% discount sa halip na penalty.
