Under Republic Act No. 11956, families of those who passed on or before May 31, 2022 can settle estate taxes at a flat 6% rate, free of penalties, surcharges, or interest—even if the estate hasn’t been assessed yet.
𝗪𝗵𝘆 𝘁𝗵𝗶𝘀 𝗺𝗮𝘁𝘁𝗲𝗿𝘀:
✅Unpaid estate taxes leave land titles in limbo
✅No title = no development, no bank financing, no peace among heirs
✅After the deadline: higher rates, surcharges, 12% interest per year, and legal complications
𝗪𝗵𝗮𝘁 𝘁𝗼 𝗱𝗼 𝗻𝗼𝘄:
Estate tax requirements (BIR: 1 original, 2 photocopies)
1. Certified true copy of Property Titles (from LRA)
2. Certificate of no improvement and certified true copies of Tax Declarations
3. LCR certified true copy of Death Certificate
4. TIN numbers of heirs
5. SPA – notarized by the Philippine Consulate if heirs are overseas
6. Photocopy of valid ID of heirs
7. Notarized extrajudicial settlement of estate (EJS)
8. Photocopy of certificate of registration of motor vehicle
9. Certification of barangay captain for claimed family home
After paying the estate tax and getting a BIR e-CAR, secure the following documents:
1. Transfer tax receipt (City Assessor’s will compute it and you pay at the City
Treasurer’s office)
2. Realty Tax Clearance (get this from the Treasurer’s office)
3. Affidavit of publication (community newspaper)
4. DAR clearance for private agriculture lots.
The BIR now allows “Pay Now, Submit Later”—so even if papers aren’t complete, you can lock in the deadline.
No further extensions are expected. Don’t wait until it’s too late.
Inaction is more expensive than compliance.
