The Maceda Law (officially the Realty Installment Buyer Protection Act – R.A. 6552) is a Philippine law that protects buyers who purchase real estate on installment basis (like house & lot, condo, or subdivision lots).

Here’s a clear and practical explanation for you as a broker:

🏡 What is the Maceda Law?

It is a law that gives rights and protection to buyers who cannot continue paying their installment due to financial difficulties.

🔑 Key Protections for Buyers

1. Grace Period (For Late Payments)
• Buyer is entitled to a grace period of at least 1 month for every year paid
• Example: If buyer paid for 3 years → 3 months grace period

👉 During this time, they can still pay without penalty.

2. Refund (For Buyers who paid 2 years or more)

If the buyer defaults:
• They are entitled to a cash surrender value (refund)
• Minimum refund:
• 50% of total payments made
• Additional 5% per year after 5 years, up to 90%

👉 This is very important when explaining to clients — they don’t lose everything.

3. Cancellation Process (Seller cannot cancel immediately)
• Seller must:
• Give notarized notice of cancellation
• Wait 30 days after notice
• Refund must be given first before cancellation becomes valid

👉 No instant cancellation allowed.

4. Rights Before 2 Years of Payment

If buyer paid less than 2 years:
• No refund yet
• But still entitled to grace period

5. Right to Reinstate or Assign

Buyer can:
• Reinstate the contract (if within grace period)
• Sell/transfer rights to another buyer

🚫 What is NOT Covered
• Bank-financed properties
• Properties paid in full (cash basis)
