IMPORTANTENG MABAYARAN ANNUALLY ANG REAL PROPERTY TAX O AMILYAR..

Marami ang akala na safe na ang property basta may titulo. Pero kapag hindi nababayaran ang amilyar o Real Property Tax, may legal power ang LGU na i-levy at ipa-auction ang property under the Local Government Code.

Kapag delayed ang bayad, may 2% interest per month hanggang 36 months. Habang tumatagal, lalo lang lumalaki ang utang. Maaari ring maglabas ang LGU ng Warrant of Levy at simulan ang proseso ng public auction ng property.

Kapag na-auction ang lupa, may one year lang ang owner para tubusin ito. Kapag hindi na-redeem sa loob ng isang taon, tuluyang mapupunta ang ownership sa buyer.

Hindi rin maibebenta o maita-transfer ang property kapag may unpaid amilyar dahil required ang RPT Clearance sa transfer ng titulo.

Sa ngayon, may tax amnesty under RA 12001 kung saan puwedeng bayaran ang basic tax lamang at waived ang penalties at interest para sa unpaid RPT before July 5, 2024. Ang amnesty ay valid hanggang July 5, 2026 lamang.

Mas mabuting maagapan habang may pagkakataon pa.

Marami pa rin ang akala na kapag OCT o TCT ang title ng agricultural land, hindi na kailangan ng DAR Clearance. Pero legally, required pa rin ito bago ma-transfer o ma-register ang sale.

Under CARP Law, lahat ng agricultural land transactions — CLOA man, EP, OCT, o TCT — kailangan ng DAR Transfer Clearance para masigurong walang legal issue, agrarian case, o violation sa land ownership rules.

Kapag walang clearance? Puwedeng ma-reject ang transfer at worst, ma-void pa ang sale kahit bayad na ang property.

Bottom line: Kapag agricultural land ang usapan, huwag i-skip ang DAR Clearance. Mas okay nang sigurado kaysa ma-problema later on.
