𝐊𝐚𝐬𝐚𝐥𝐚𝐧𝐚𝐧 𝐌𝐨 𝐍𝐚 𝐊𝐮𝐧𝐠 𝐍𝐢𝐥𝐚𝐤𝐭𝐚𝐰𝐚𝐧 𝐌𝐨 𝐈𝐭𝐨𝐧𝐠 𝐃𝐮𝐞 𝐃𝐢𝐥𝐢𝐠𝐞𝐧𝐜𝐞 𝐒𝐭𝐞𝐩𝐬 𝐍𝐚 '𝐓𝐨 𝐀𝐭 𝐍𝐚𝐬𝐜𝐚𝐦 𝐊𝐚
Ito ang sabi ng batas, sa madaling salita.
Maraming buyers ang nag-iisip: "May title naman, safe na 'to." Pero malinaw ang sinabi ng Supreme Court — ang clean title alone ay 𝘩𝘪𝘯𝘥𝘪 sapat para maging "buyer in good faith" ka.
Sa kaso ng 𝘚𝘱𝘰𝘶𝘴𝘦𝘴 𝘔𝘢𝘯𝘢𝘭𝘦𝘴𝘦 𝘷. 𝘌𝘴𝘵𝘢𝘵𝘦 𝘰𝘧 𝘍𝘦𝘳𝘳𝘦𝘳𝘢𝘴 (G.R. No. 254046, November 25, 2024), sinabi ng Korte na ang mga buyer na hindi nag-verify sa Registry of Deeds — kahit mukhang mailins ang title — ay 𝘩𝘪𝘯𝘥𝘪 protektado ng batas. Nawala sa kanila ang property.
Kaya bago mo ibigay ang pinaghirapan mong pera, narito ang minimum due diligence checklist. Hindi ito optional — ito ang panangga mo sa mga pandurugas.
🏠 𝗦𝘁𝗲𝗽 𝟭: 𝗜-𝘃𝗲𝗿𝗶𝗳𝘆 𝗮𝗻𝗴 𝗧𝗶𝘁𝗹𝗲 𝘀𝗮 𝗥𝗲𝗴𝗶𝘀𝘁𝗿𝘆 𝗼𝗳 𝗗𝗲𝗲𝗱𝘀
Huwag umasa sa photocopy ng seller. Pumunta sa Registry of Deeds (RD) at mag-request ng Certified True Copy (CTC) ng title — TCT (Transfer Certificate of Title) o OCT (Original Certificate of Title). Pwede na rin itong gawin online sa LRA eSerbisyo portal (eserbisyo . lra . gov . ph) o walk-in sa kahit anong computerized RD sa ilalim ng Anywhere-to-Anywhere system.
Ano ang i-check: Tugma ba ang registered owner sa seller? May mga annotations ba sa likod — mortgages, adverse claims, lis pendens, o liens? Tugma ba ang lot number, area, at location sa actual na binebenta sayo?
📋 𝗦𝘁𝗲𝗽 𝟮: 𝗜-𝗰𝗵𝗲𝗰𝗸 𝗮𝗻𝗴 𝗧𝗮𝘅 𝗗𝗲𝗰𝗹𝗮𝗿𝗮𝘁𝗶𝗼𝗻
Pumunta sa City o Municipal Assessor's Office at mag-request ng certified true copy ng Tax Declaration. I-check: Tugma ba ang declared owner sa title? Tama ba ang land classification (residential, agricultural, commercial)? Updated ba ang bayad sa real property tax? Ang hindi nabayarang tax ay pwedeng maging hadlang sa title transfer.
Pwede rin mag-request ng Tax Clearance sa Treasurer's Office.
📐 𝗦𝘁𝗲𝗽 𝟯: 𝗜-𝘃𝗲𝗿𝗶𝗳𝘆 𝗮𝗻𝗴 𝗕𝗼𝘂𝗻𝗱𝗮𝗿𝗶𝗲𝘀
Mag-hire ng licensed Geodetic Engineer para gumawa ng relocation survey. Kino-confirm nito na ang physical boundaries ng lote ay tugma sa technical description na nakalagay sa title. Ang boundary disputes ay isa sa karaniwang dahilan ng mga kaso sa property. Huwag itong i-skip.
🏗️ 𝗦𝘁𝗲𝗽 𝟰: 𝗣𝘂𝗺𝘂𝗻𝘁𝗮 𝗦𝗮 𝗣𝗿𝗼𝗽𝗲𝗿𝘁𝘆 𝗡𝗴 𝗣𝗲𝗿𝘀𝗼𝗻𝗮𝗹
Mag-ocular inspection. May ibang tao bang nakatira o nag-o-occupy sa lupa? May mga structures, bakod, o improvements ba na nagpapakitang may ibang claimants? Tingnan ang road access, easements, at rights of way. Kausapin ang mga kapitbahay at ang barangay — madalas, alam nila ang mga bagay na wala sa papeles.
⚖️ 𝗦𝘁𝗲𝗽 𝟱: 𝗜-𝗰𝗵𝗲𝗰𝗸 𝗮𝗻𝗴 𝗔𝘂𝘁𝗵𝗼𝗿𝗶𝘁𝘆 𝗻𝗴 𝗦𝗲𝗹𝗹𝗲𝗿
Kung hindi ang seller ang registered owner, humingi ng notarized Special Power of Attorney (SPA). Kung conjugal o community property ang binebenta, kailangan din ng consent ng asawa. Kung inherited property, dapat may Extrajudicial Settlement of Estate na maayos ang pagkaka-execute, at pumayag ang lahat ng heirs sa sale.
🌾 𝗕𝗼𝗻𝘂𝘀: 𝗠𝗴𝗮 𝗦𝗽𝗲𝗰𝗶𝗮𝗹 𝗖𝗮𝘀𝗲𝘀 𝗻𝗮 𝗞𝗮𝗶𝗹𝗮𝗻𝗴𝗮𝗻 𝗕𝗮𝗻𝘁𝗮𝘆𝗮𝗻
Agricultural land? Mag-check sa Department of Agrarian Reform (DAR) para sa restrictions o required clearances.
Condo unit? Siguraduhing may License to Sell ang developer mula sa DHSUD at maayos ang Condominium Certificate of Title (CCT).
Foreclosed property? I-confirm na nag-lapse na ang lahat ng redemption periods.
𝗔𝗻𝗴 𝗯𝗼𝘁𝘁𝗼𝗺 𝗹𝗶𝗻𝗲: Ang paggastos ng ilang libong piso sa due diligence ay pwedeng mag-save sa'yo ng milyones sa korte. Sa ilalim ng Philippine law, expected ang buyers na maging maingat — ang "Hindi ko alam" ay hindi legal defense. Protektahan ang investment mo. Gawin ang homework mo 𝘣𝘢𝘨𝘰 ka pumirma ng kahit ano.
