How to Check if a Title Is Clean?

Here’s a guide para iwas-scam at iwas-stress sa pagbili ng lupa o bahay 👇



⭐ What is a “Clean Title”?

A clean title means:

✅Walang utang
✅Walang komplikasyon
✅Walang pending case
✅Walang ibang may-ari na nagke-claim
✅Transferable without legal issues

In short — legit, safe, and good to buy.



1️⃣ Check the Original Owner’s Copy (TCT or CCT)

When the seller gives a photocopy, check these parts:

✅Title Number (TCT/CCT No. ____ )
✅Name of Registered Owner
✅Lot / Block / Unit details
✅Land area (sqm)

Red flag:

❌ Blurry or cropped copy
❌ Pinagtagpi-tagping pages
❌ Wala yung last page



2️⃣ Check the “Memorandum of Encumbrances” (Back Page)

This is where you’ll see kung:

✅May mortgage / nakasangla
✅May lis pendens (pending court case)
✅May right of way issues
✅May heirs claiming interest
✅May DAR/Agrarian restrictions
✅May tax liens

Green flag = Blank page
Red flag = Anything written na hindi mo naiintindihan.



3️⃣ Verify the Title at the Registry of Deeds (RoD)

Go to the Registry of Deeds where the property is located and request:

✅Certified True Copy (CTC) of Title
This is the most accurate and most updated copy.

Bakit importante?
Because some sellers use OLD titles.
Pero sa RoD, lalabas lahat ng encumbrances, updated.



4️⃣ Check the Tax Declaration

Ask for the latest:
✅Tax Declaration (TD)
✅Real Property Tax (RPT) Clearance

Tingnan kung:
• Name matches the title
• No unpaid taxes
• No arrears

Red flag:
❌ TD is under a different name
❌ TD is “land only” but they’re selling house & lot
❌ Unpaid taxes for many years



5️⃣ Validate the Lot Location Through a Geodetic Engineer

Lot verification prevents “wrong lot” or “lot shifting.”

A licensed GE can confirm:
✅Tama ang location
✅Tama ang boundaries
✅Walang overlapping lots
✅Pasok sa title ang actual shape + size

Hint:
This is often skipped by buyers — but VERY important.



6️⃣ Ask for IDs + SPA (If Representative Only)

To avoid fake sellers:
✅Verify government IDs
✅If agent/relative → must have Notarized Special Power of Attorney (SPA)

No SPA = don’t proceed.



7️⃣ Check for Red Flags in the Seller’s Story

Be cautious if:
🚩 Super mura
🚩 “Rush sale”
🚩 “Wag ka na mag-verify, legit ‘to”
🚩 “Friend ng relative ng kapitbahay”
🚩 Ayaw magbigay ng title copy
🚩 Ayaw magpunta sa RoD

The cleaner the title, the more transparent the seller.



8️⃣ If Property Is Agricultural, Check DAR Restrictions

Farm lots may have:
• EP/CLOA restrictions
• No-sale rules
• Agrarian reform limitations

If may nakasulat sa back page like:
“Cannot be sold or transferred except by hereditary succession”
👉 Huwag bilhin.



⭐ FINAL VERDICT:

A title is clean if:
✅No encumbrances
✅No court cases
✅No mortgages
✅No restrictions
✅Updated ang RoD copy
✅ Location matches the plan
✅Seller is legit

Kung may kahit isang red flag →
STOP and verify before paying anything.

📌Tandaan: Kapag masyadong mura ang benta (too good to be true) o nagmamadali ang seller na bayaran agad, mag-ingat—madalas dyan ang scam.
