جائیداد مالکان کیلئے بڑی خوشخبری: سیکشن 7E کالعدم قرار۔

وفاقی آئینی عدالت نے انکم ٹیکس آرڈیننس کے سیکشن 7E کو غیر آئینی (Ultra Vires) قرار دیتے ہوئے ختم کر دیا ہے۔

یہ فیصلہ پاکستان کے رئیل اسٹیٹ سیکٹر اور جائیداد مالکان کیلئے انتہائی اہم پیش رفت تصور کیا جا رہا ہے۔

سیکشن 7E کیا تھا؟
فنانس ایکٹ 2022 کے تحت متعارف کروائے گئے سیکشن 7E کے مطابق اگر کسی شخص کے پاس ایک سے زائد جائیداد موجود ہو، تو حکومت یہ تصور کرتی تھی کہ اس جائیداد سے اس کی مارکیٹ ویلیو کے 5 فیصد کے برابر آمدن حاصل ہو رہی ہے، چاہے حقیقت میں کوئی کرایہ یا آمدن نہ ہو۔ اسی فرضی آمدن پر وفاقی انکم ٹیکس عائد کیا جاتا تھا۔

آئینی تنازع کیا تھا؟
قانونی ماہرین کے مطابق پاکستان کے آئین کے تحت وفاق صرف "آمدن" پر ٹیکس لگا سکتا ہے، جبکہ غیر منقولہ جائیداد پر ٹیکس لگانے کا اختیار صوبوں کے پاس ہے۔ اس لیے مؤقف اختیار کیا گیا کہ سیکشن 7E دراصل پراپرٹی ٹیکس تھا جسے انکم ٹیکس کا نام دیا گیا۔

عدالت کا فیصلہ
وفاقی آئینی عدالت نے اپنے فیصلے میں قرار دیا کہ سیکشن 7E وفاقی حکومت کے آئینی اختیارات سے تجاوز تھا، لہٰذا یہ قانون آئین سے متصادم ہے۔

یہ فیصلہ جائیداد مالکان کیلئے ایک بڑی قانونی اور مالی ریلیف سمجھا جا رہا ہے اور اس سے وفاق اور صوبوں کے ٹیکس اختیارات کی آئینی حد بھی واضح ہو گئی ہے۔
