It’s official: Portugal just approved one of the biggest housing tax shakeups in recent years.

The new Decree-Law No. 97/2026 has now been published, introducing major tax relief measures aimed at increasing housing supply and tackling the country’s housing crisis.

Whether you’re a homeowner, landlord, investor, tenant, or planning to build — these changes could directly impact your finances.

👇 Here are the 4 biggest takeaways:

6% VAT on Construction & Renovation

Construction and rehabilitation projects intended for primary residences or affordable housing can now benefit from a reduced 6% VAT rate.

✅ Applies to:
• Homes sold below approx. €660,000
• Rental properties with rents under €2,300/month

A major incentive for developers, builders, and anyone planning to construct or renovate residential property.

10% IRS Rate for Landlords

To encourage more rental supply, landlords offering “moderate rents” (up to €2,300/month) may now opt for a reduced flat IRS rate of just 10% on rental income.

Even better:
✔️ Existing contracts already active at the start of the year may also qualify.

Capital Gains Tax Exemption

Capital gains from property sales may become tax-exempt if reinvested into the affordable rental market.

Conditions include:
• Rent capped at €2,300/month
• Property must be rented for at least 36 months within a 5-year period
