The Sail Wins Two MIPIM Asia Awards

NBBJ has received two significant awards for its innovative work on The Sail @ Marina Bay, a 1.2-million-square-foot mixed-use structure in the Republic of Singapore and one of the Republic’s first highly sustainable mixed-use developments.

NBBJ’s work was recognized at the MIPIM Asia conference, garnering first place in both the Residential Developments and the Participants’ Choice categories. More than 70 projects from 13 different countries throughout the Asia Pacific region were submitted for the MIPIM Asia Awards. The only project to win more than one category, the Sail is a collaborative effort of NBBJ’s New York and Los Angeles studios.

“The Sail will do more than just enhance Singapore’s reputation as a dynamic and beautiful place to live,” said NBBJ principal Timothy Johnson. “The buildings will also enable Singapore to compete for global citizens from all over the world by delivering high quality design and a new urban living environment and experience.”

Completed in August 2008, the 735-foot-tall Sail @ Marina Bay is the tallest residential high-rise in Singapore. Drawing inspiration from the wind, water and sun, NBBJ designed two glass-clad towers rising from a sculpted base. The innovative design makes both towers appear to be sails that are full of wind. The award-winning complex consists of a 63-story and a 70-story building featuring 1,111 residences, restaurants, health clubs, recreation decks with pools and tennis courts, and parking facilities.

More than 65% of the apartments command water views, giving residents panoramic vistas of the Marina Bay and the central city’s cultural, entertainment and retail areas. A quintet of “six-star” penthouses are the highest residential units in Singapore, and all of them have breathtaking views of the sea and islands beyond. The project includes amenities such as a hotel-style concierge service, a spa and an executive club lounge with dining facilities. Units in Tower One sold out in two weeks, while Tower Two was fully committed in two days. Sales prices for the units set new records for the Southeast Asia residential market.

The tower is fast becoming a new destination within the rich and diverse fabric of Singapore, while setting a benchmark for future buildings along Marina Bay. Developed by City Development Ltd. and AIG, the $200 million property incorporates various sustainable innovations such as high performance glazing. The Sail is one of the first residential towers in Singapore to utilize high performance glazing, which effectively reduces solar heat gain and lowers air conditioning usage. The building also is BCA Green Mark Gold Certified, the Singapore Government’s rating system for sustainable buildings.

Along with NBBJ, members of the design team include Team Design, associate architect; Kiat Supattapone, consulting architect; Axis, interior architects; and Belt Collins, landscape architects. Also involved in the project were Dragages Singapore - Bouygues Construction; structural engineers Precast Design Consultants and Meinhardt Pte Ltd, which also served as mechanical and electrical engineers; Davis Langdon & Seah, quantity surveyor/construction cost consultants; Cornell Wagner, curtain wall consultants; and lighting consultants LPA.

A bitter and long-running dispute between owners at posh condominium The Sail@Marina Bay and City Developments (CDL) over alleged defects will finally be heard in court next month.

The row has been festering for about four years, with owners pointing to a range of alleged defects at the 1,111-unit project, which received its temporary occupation permits in 2008.

The most serious and costly defect is said to be the rubbish chute system, which has resulted in residents having to put up with unpleasant smells. There have also been complaints about water leaks at the lift areas and burst underground water pipes that had to be repaired. In all, residents have forked out more than $1 million to rectify problems, with more to come.

The condominium's Management Corporation Strata Title (MCST) is holding an extraordinary general meeting on Saturday next week to seek owner approval to use $3.3 million from the sinking fund to replace the vertical section of the waste collection system.

It also wants consent to use up to $450,000 from the management fund for legal proceedings and another $100,000 to engage non-legal experts. Trial hearings are scheduled to be held on Feb 6.

The MCST's statement of claims alleges that "numerous defects have become manifestly apparent in the development and which demonstrate a failure to develop and/or construct the development in a good and workman-like manner with reasonable skill and care and/or to ensure that the development is reasonably fit for the purpose for which it was intended".

It also claims that CDL is in breach of contract against the original buyers and its duty of care to design and construct the development to "a reasonable, functional and safe standard", to ensure that it would be reasonably free of defects, and to maintain it in good condition before the handover of management and maintenance to the MCST.

CDL had earlier denied the claims but said yesterday that it was unable to comment further as it is an ongoing court matter.

Dragages Singapore - the project's main contractor - is also named as a defendant in the lawsuit. It has denied that it is liable for any alleged defects.

Both defendants have noted that The Sail@Marina Bay was awarded a high Construction Quality Assessment System score, an assessment of building quality by the Building and Construction Authority (BCA).

Its score of 94.8 per cent puts the estate among the top 10 per cent of all private housing projects in Singapore since 1988, CDL said in its statement of defence. The project also received an award for construction excellence from the BCA in 2010.

Meanwhile, CDL has fended off a separate legal dispute raised by owners of Shelford Suites, whose MCST filed a legal complaint against CDL and main contractor Tiong Seng Contractors last year.

Owners also claimed numerous defects but it is understood that the issues have been resolved.

SINGAPORE: Residents of The Sail @ Marina Bay have resolved a long-running dispute with the luxury condominium's developer Glengary and contractor Dragages Singapore over what they claim are property defects.

The case was scheduled to be heard by the courts on Tuesday (Feb 6), but the parties involved reached an agreement following two days of negotiations. When contacted, they declined to reveal details of the agreement, citing confidentiality.

The saga began in 2013 when the residents mandated the condominium’s Management Corporation Strata Title (MCST) to take its developer, a subsidiary of City Developments Limited (CDL), to task. Several letters of demand were sent to CDL, calling for it to rectify the defects. A writ of summons and statement of claim were filed a year later.

At the heart of the dispute is what residents say is a defective rubbish chute system. According to the statement of claims, there were foul smells, intermittent blockages to the refuse chute pipes and cockroach infestations.

When Channel NewsAsia visited the condominium last month, the chutes were found to have been temporarily sealed and residents had to leave their bags of trash on the floor in the bin room. The development’s management council told Channel NewsAsia that extra cleaners had to be hired to manually remove the bags of rubbish left outside the chutes several times a day.

There were also other complaints about damaged fixtures, which included burst underground water pipes. According to the statement of claims, the MCST incurred costs of at least S$1.2 million as of April 2015 to rectify the problems.

In their statement of defence, both Glengary and Dragages highlighted the fact that The Sail was awarded a 94.8 per cent Construction Quality Assessment System score, an assessment of building quality by the Building and Construction Authority.

In an extraordinary general meeting held on Jan 27, the MCST sought the residents' consent to use up to S$3.3 million from the sinking fund to replace the vertical section of the waste collection system.

MCST chairman S K Cheah said the condominium’s management committee has put out a tender for replacement works for the rubbish chute, and has shortlisted contractors. He added that work is expected to start within the next couple of months.

Bags of rubbish would often get stuck in the chutes, causing a foul smell and attracting pests, residents told Channel NewsAsia on Wednesday (Jan 17).

They say they have had to bear with the stench for almost eight years.

Investigations conducted by the condominium’s Management Corporation Strata Title (MCST) attributed the problem to the defective design of the chute system.

In 2013, residents mandated the MCST to take developer City Developments Limited (CDL) to task. Several letters of demand were sent to CDL, calling for it to rectify the defects. A writ of summons and statement of claim were filed a year later.

Four years on, the long-running saga has not been resolved and the case will be heard by the courts on Feb 6.

When contacted, CDL confirmed the lawsuit. A spokesman declined to comment further as the case is now before the courts.

Once touted as Singapore's finest luxury condominium, few would have heard about the smelly rubbish chutes that residents have had to live with.

A 59-year-old resident who wanted to be known only as Ms Kym said: “The garbage chute has been out for a long time and we haven’t been able to use it. This for me is the biggest problem ... the smell is atrocious."

She added: "The lifts have also been breaking down a little bit and this throws the building out because we’ve got 69 floors and many units."

Another resident Marjorie Wu, 22, said: “My father comes down to the loading bay on the first floor to throw our bags of rubbish every day.”

One resident with knowledge of the lawsuit told Channel NewsAsia that the defective design was “one of the main issue(s) in the lawsuit”.

When Channel NewsAsia visited the condominium on Wednesday, the chutes were sealed and repair works were under way.

The development’s management council told Channel NewsAsia that extra cleaners have to be hired to manually remove the bags of rubbish left outside the chutes several times a day.

The MCST is also seeking monetary compensation for damaged fixtures, which includes burst water pipes underground.

In an upcoming extraordinary general meeting next Saturday, the MCST will seek the residents' consent to use up to S$3.3 million from the sinking fund to replace the entire rubbish chute system. It will also seek consent to use up to S$450,000 from the management fund for legal proceedings.
