Hey everyone!
Have you seen the latest headlines about the upcoming changes to the en bloc rules?
If you or someone you know owns an older condo, or if you're eyeing the property market for opportunities, this is a major update you need to pay attention to! Let's break down what the proposed amendments to the Land Titles (Strata) Act mean for you.
What are the Proposed Changes?
According to recent reports, a Bill was introduced in Parliament on August 4 to revamp the collective sale regime. Here are the key takeaways:
* Lowered Consent Thresholds for Ageing Estates: The threshold to launch an en bloc sale is proposed to drop to 70 per cent for developments aged 40 to 59 years.
* Even Lower for 60+ Years: For developments 60 years and older, the required consent would be further lowered to 65 per cent. Consent thresholds for newer projects under 40 years will remain unchanged.
* Faster Timelines: The signature collection period that Collective Sale Committees (CSCs) have is proposed to be cut from 12 months to six months.
* Stricter Safeguards: To protect non-consenting owners, the requirement to convene a general meeting to form a CSC will be raised to 35 per cent of owners (by share value or number of units), up from the current 20 per cent or 25 per cent.
* Longer Restriction Periods: If an attempt fails, stricter rules will apply for subsequent attempts made within the next three years, instead of the current two years.
📉 What Does This Mean For Sellers?
If you own a property in one of the roughly 150 private non-landed developments aged between 40 and 59 years, or the handful aged 60 and above, this could be your golden ticket. Older developments tend to face rising maintenance costs and depleting sinking funds. A lowered threshold means a higher chance of successfully unlocking your property's value for your retirement or your next upgrade.
Seller Concerns to Think About:
* Are you prepared for the faster 6-month signature timeline?
* If the sale goes through, do you have a right-sizing or replacement property plan in place, especially given current market prices?
📈 What Does This Mean For Buyers & Investors?
For buyers, these reforms could eventually bring a fresh wave of supply to the market. Massive older estates sitting on prime land—such as Braddell View, Laguna Park, or Pine Grove—could potentially be redeveloped to yield thousands of new homes. In fact, around 40 per cent of these older developments are located in prime Districts 9, 10, and 11, which might mean more exciting new launch options in the future.
Buyer Concerns to Think About:
* Will this spark an en bloc premium on older resale condos?
* Should you buy into an older property now hoping for a windfall, or is the risk of a failed attempt (and a 3-year restriction period) too high?
Let's Discuss! 👇
I want to hear from you:
* Do you think 65% or 70% is fair for older estates, or does it put too much pressure on the minority owners who wish to stay?
* Would you invest in an older condo today just for the en bloc potential?
