Can Foreigners Buy Property in Phuket?
Short answer: Yes, but with rules. Thai law treats apartments (condos) and houses (villas) very differently.
𝑯𝒆𝒓𝒆 𝒊𝒔 𝒘𝒉𝒂𝒕 𝒚𝒐𝒖 𝒏𝒆𝒆𝒅 𝒕𝒐 𝒌𝒏𝒐𝒘:
𝟏. 𝐂𝐨𝐧𝐝𝐨𝐬 = 𝐄𝐚𝐬𝐢𝐞𝐬𝐭 𝐑𝐨𝐮𝐭𝐞 (𝐅𝐫𝐞𝐞𝐡𝐨𝐥𝐝 𝐎𝐰𝐧𝐞𝐫𝐬𝐡𝐢𝐩)
You can 100% own a condo in your own name, but there is a catch:
The 49% Rule: Foreigners can only own up to 49% of the total space in a condo building. The rest must be owned by Thai nationals.
What to do: Always ask the sales team: "Is the foreign quota full?" If it’s full, you cannot own it permanently and will have to lease it instead.
𝟐. 𝐇𝐨𝐮𝐬𝐞𝐬 & 𝐕𝐢𝐥𝐥𝐚𝐬 = 𝐋𝐚𝐧𝐝 𝐑𝐞𝐬𝐭𝐫𝐢𝐜𝐭𝐢𝐨𝐧𝐬
Foreigners cannot own land in Thailand. If you want a villa or house, you have two main options:
Leasehold (Recommended & Safer): You lease the land for 30 years (often with options to renew). However, you legally own the actual house building.

"𝐇𝐢𝐫𝐞 𝐲𝐨𝐮𝐫 𝐨𝐰𝐧 𝐥𝐚𝐰𝐲𝐞𝐫." Have an independent lawyer check the contracts and land titles first. It is a big investment.
