👩‍❤️‍👨👨‍❤️‍👨👩‍❤️‍💋‍👩คู่รักที่ไม่จดทะเบียนสมรส มีสิทธิได้ส่วนแบ่งทรัพย์สินหรือไม่❓

💝💖สำหรับคู่รักที่ไม่ได้จดทะเบียนสมรส กฎหมายไม่ได้กำหนดในเรื่องของการแบ่งแยกทรัพย์สินรวมทั้งการจัดการทรัพย์สินระหว่างกันว่าจะต้องแบ่งแยกหรือจัดการกันอย่างไร แม้กฎหมายจะไม่ได้กำหนดไว้เป็นการเฉพาะสำหรับคู่รัก แต่ด้วยปัญหาที่เกิดขึ้นเกี่ยวกับการจัดการทรัพย์สินที่ทำมาหาได้ร่วมกันระหว่างคู่รักก็ทำให้มีคดีมากมายขึ้นสู่ศาล ในประเด็นปัญหานี้ศาลฎีกาได้มีแนวคำพิพากษาวางไว้ว่าทรัพย์สินที่เกิดจากการทำมาหาได้ร่วมกันจะถือว่าเป็น “กรรมสิทธิ์รวม” ของคู่รัก มีผลให้คู่รักต่างมีสิทธิในทรัพย์สินนั้นคนละกึ่งหนึ่ง ตามตัวอย่างคำพิพากษาที่ได้ยกมาดังนี้

💗ฝ่ายชายและหญิงอยู่ร่วมกันอย่างสามีภรรยาโดยไม่ได้จดทะเบียนสมรส ทั้งคู่ต่างทำกิจการการค้าร่วมกัน ทรัพย์สินที่เกิดขึ้นในระหว่างที่อยู่ร่วมกันนั้นจึงถือได้ว่าเป็นของทั้งคู่ ต่างฝ่ายต่างมีกรรมสิทธิ์ร่วมกันในทรัพย์สินจึงต้องแบ่งทรัพย์สินนั้นให้แต่ละฝ่ายคนละกึ่งหนึ่ง (อ้างอิงคำพิพากษาฎีกาที่ 1512/2519)

💗ฝ่ายชายและหญิงได้อยู่ร่วมกันอย่างสามีภรรยาโดยไม่ได้จดทะเบียนสมรส ต่อมาทั้งคู่ได้ซื้อที่ดิน 1 แปลงซึ่งถือได้ว่าเป็นทรัพย์สินที่ได้มาจากการทำมาหาได้ร่วมกันโดยใส่ชื่อฝ่ายชายเป็นเจ้าของกรรมสิทธิ์ในโฉนด ที่ดินแปลงดังกล่าวแม้จะมีแค่ชื่อฝ่ายชายแต่ที่ดินนั้นถือได้ว่าเป็นทรัพย์สินที่เกิดจากการทำมาหาได้ร่วมกันจึงถือได้ว่าทั้งคู่ต่างมีกรรมสิทธิ์ร่วมกันในที่ดินแปลงนั้นคนละกึ่งหนึ่ง (อ้างอิงคำพิพากษาฎีกาที่ 786/2533)

💗นางสาว A และนางสาว B อยู่ร่วมกันอย่างคู่รักมาเกือบ 20 ปี นางสาว A มีหน้าที่หลักในการหาเงินเข้าบ้าน ส่วนนางสาว B ลงแรงในการดูแลบ้านในฐานะแม่บ้าน ถือได้ว่าทั้งสองฝ่ายต่างร่วมกันทำมาหากิน ดังนั้นทรัพย์สินที่เกิดขึ้นมาในระหว่างที่อยู่ร่วมกันจึงถือได้ว่าเป็นทรัพย์สินที่ทั้งนางสาว A และนางสาว B ต่างมีเจตนาที่จะเป็นเจ้าของร่วมกัน ทั้งคู่จึงมีส่วนในทรัพย์สินนั้นคนละกึ่งหนึ่ง (อ้างอิงคำพิพากษาฎีกาที่ 3725/2532)

❌ในเรื่องของทรัพย์สินที่ได้มาระหว่างการใช้ชีวิตอยู่ร่วมกันของคู่รัก ก็มีทรัพย์สินบางอย่างที่ไม่ถือว่าเป็นกรรมสิทธิ์รวมเพราะไม่ได้เกิดจากการทำมาหาได้ร่วมกัน เช่น ทรัพย์สินที่ได้มาโดยมรดก ทรัพย์สินที่ได้มาโดยการให้โดยเสน่หา ถูกรางวัลสลากกินแบ่งรัฐบาล ทรัพย์สินที่เกิดจากการทำมาหาได้ของฝ่ายใดฝ่ายหนึ่งแต่เพียงฝ่ายเดียวแม้จะมีการอยู่ร่วมกันแต่หากคู่รักอีกฝ่ายไม่ได้มีส่วนช่วยในการทำมาหาได้ก็จะไม่ถือว่าทรัพย์สินนั้นเป็นกรรมสิทธิ์รวม เป็นต้น
