📌 What is a Power of Attorney and Why is it Important?
Why Do You Need One,
and When Is It Used?
(With Guidelines on Choosing the Right Form) ✍️✨
Have you ever wanted to handle government transactions or execute important contracts, but were "busy," "out of town," or "unable to take leave"?
The solution that allows your business to move forward without interruption is a "Power of Attorney"!
🔖 Today, we have gathered knowledge on this topic, from benefits, pros, and cons, to how to choose the right power of attorney form 👇
🔖 What is a Power of Attorney & Why Use It?
It is… a legal document created to appoint someone we trust to perform legal acts or transactions on our behalf.
The result of that action will be legally binding as if we performed it ourselves in every respect.📌
🏢 When Is It Used & In What Cases?
* 🏠 Real Estate:
House transfer, land purchase/sale, mortgage registration, applying for water/electricity meters
* 🚗 Automotive:
Vehicle title transfer, tax renewal, changing vehicle color/engine
* 🏛️ Government & Private Sector:
Applying for permits, contacting the Revenue Department, receiving checks, filing lawsuits
* 💼 Business:
Authorizing a representative or manager to sign contracts with partners on behalf of the owner
📍📄 Should You Use a "General Power of Attorney" or a "Specific Power of Attorney"?
🔴 Cases Where You "MUST Use a Specific Power of Attorney" Only📌📌
* 🏢 Department of Lands:
🔰 Buying, selling, transferring, mortgaging, leasing, or executing transactions at the Department of Lands
MUST use the Department of Lands' official Form Tor.Dor. 21 only‼️
(Officers will strictly reject general power of attorney forms)
* 💼 Department of Business
Development (DBD) / Department of Intellectual Property:
🔰 MUST use the specific forms of that agency for registration or filing property rights‼️
🟢 Cases Where a "General Power of Attorney Can Be Used"✅
* 📦 General Private Sector Work:
🔶 Receiving checks, delivering goods, coordinating with business partners, requesting company documents
* 📋 Administrative Work:
🔶 Authorizing a representative to temporarily oversee business operations or request preliminary information from various agencies
📍 Pros VS Cons (Things to Know Before Signing!)📍
✅ Pros
* ⏳ Saves Time:
No need to waste time traveling yourself; if you are busy, someone else can do it for you
* 🚀 Business Continuity:
Even if you are absent, business operations or asset transfers can proceed immediately
* 📜 Clear Evidence:
The scope of authority is specified clearly in writing and can be verified
❌ Cons / Cautions
* ⚠️ Risk of Exceeding Authority:
If written too broadly, the attorney-in-fact may be able to perform actions you did not intend to grant
* 📝 Document Errors:
May result in wasted time because officers in that organization, government agencies, or the Department of Lands will immediately reject the matter
🔖✍️ How to Make It Correct and Legally Enforceable?
1️⃣ Choose the Right Form:
Use general forms for general transactions; use Form Tor.Dor. 21 for land transactions
2️⃣ Specify Details Clearly:
Write the correct full name and ID card number of both parties
3️⃣ Limit the Scope of Authority:
Clearly state what task is authorized and where
(Never write broadly like "authorized to perform everything on my behalf"—strictly prohibited, very dangerous‼️)
4️⃣ Attach Copies of Required Documents:
Copy of ID card + copy of house registration of both the grantor and the attorney-in-fact, certified as true copies
5️⃣ Signatures & Witnesses:
Signed by the grantor and attorney-in-fact, with at least 1-2 witnesses signing as well
6️⃣ Affix Revenue Stamps:
* Authorization for a single act/transaction:
Affix 10 THB
* Authorization for multiple acts/transactions:
Affix 30 THB
⭐️⭐️ In Short: A Power of Attorney acts as our "representative."
The most important things📍 are "trust"
and "choosing the correct form while clearly defining the scope of authority"
📍 to protect our own rights! ✌️✌️
