𝐓𝐡𝐚𝐢𝐥𝐚𝐧𝐝 𝐧𝐨𝐦𝐢𝐧𝐞𝐞 𝐜𝐫𝐚𝐜𝐤𝐝𝐨𝐰𝐧: 𝐟𝐚𝐜𝐭𝐬 𝐨𝐯𝐞𝐫 𝐟𝐞𝐚𝐫
Let’s apply a little common sense.
The recent headlines about nominee company crackdowns in Thailand are not about ordinary foreign residents quietly living in their family home, paying their bills, supporting the local economy, and getting on with life.
What is actually making the headlines are cases involving suspicious business structures, unlicensed operations, illegal tourism businesses, land grabs, tax avoidance, sham shareholders, and dodgy arrangements on islands such as Koh Phangan, Samui, and Phuket.
That is a very different story.
One raid on a questionable business can suddenly become twenty scary headlines.
Then those headlines get copied, shared, translated, reposted, exaggerated, and recycled across Facebook until it looks like half the country is being raided before breakfast.
And of course, the moment fear spreads, the hungry army of lawyers, advisors, “experts”, and panic-merchants jumps on it.
“𝐔𝐫𝐠𝐞𝐧𝐭 𝐫𝐞𝐯𝐢𝐞𝐰 𝐧𝐞𝐞𝐝𝐞𝐝.”
“𝐘𝐨𝐮𝐫 𝐜𝐨𝐦𝐩𝐚𝐧𝐲 𝐦𝐚𝐲 𝐛𝐞 𝐚𝐭 𝐫𝐢𝐬𝐤.”
“𝐂𝐨𝐧𝐭𝐚𝐜𝐭 𝐮𝐬 𝐢𝐦𝐦𝐞𝐝𝐢𝐚𝐭𝐞𝐥𝐲.”
How convenient.
Let’s be honest: cracking down on illegal nominee networks is not unreasonable.
If people use fake shareholders to hide illegal businesses, avoid tax, operate hotels without licenses, buy up land through sham structures, or run businesses they are not legally allowed to run, then yes, the authorities have every right to investigate.
But turning that into panic among normal foreign homeowners is pure fear marketing.
There is a difference between enforcement and hysteria.
There is a difference between a dodgy island business operation and a long-term resident who has lived in Thailand for years, paid taxes, supported Thai families, maintained a home, employed local people, and contributed to the community.
So our view is simple:
Clean up the real abuse. 𝐅𝐢𝐧𝐞.
Go after illegal businesses. 𝐅𝐢𝐧𝐞.
Investigate tax evasion, sham ownership, and fake company structures. 𝐅𝐢𝐧𝐞.
But stop pretending every foreigner with a Thai company is suddenly part of some criminal masterplan.
𝐅𝐞𝐚𝐫 𝐬𝐞𝐥𝐥𝐬. 𝐅𝐚𝐜𝐭𝐬 𝐦𝐚𝐭𝐭𝐞𝐫.
And before everyone runs to the nearest lawyer with their wallet open, take a breath, look at what the actual cases are about, and separate real legal risk from recycled clickbait.

การปราบปรามนอมินีในประเทศไทย: ข้อเท็จจริงต้องมาก่อนความกลัว
ลองใช้สามัญสำนึกกันสักนิด
ข่าวช่วงนี้เกี่ยวกับการปราบปรามบริษัทนอมินีในประเทศไทย ไม่ได้หมายความว่าชาวต่างชาติทั่วไปที่อาศัยอยู่เงียบๆ ในบ้านของตัวเอง จ่ายค่าใช้จ่ายตามปกติ สนับสนุนเศรษฐกิจท้องถิ่น และใช้ชีวิตอย่างถูกต้อง กำลังตกเป็นเป้าหมายทั้งหมด
สิ่งที่เป็นข่าวจริงๆ คือกรณีที่เกี่ยวข้องกับโครงสร้างธุรกิจที่น่าสงสัย การประกอบธุรกิจโดยไม่มีใบอนุญาต ธุรกิจท่องเที่ยวผิดกฎหมาย การกว้านซื้อที่ดิน การหลีกเลี่ยงภาษี ผู้ถือหุ้นนอมินี และการจัดโครงสร้างที่ไม่โปร่งใส โดยเฉพาะในพื้นที่อย่างเกาะพะงัน สมุย และภูเก็ต
นั่นเป็นคนละเรื่องกันอย่างสิ้นเชิง
การบุกตรวจธุรกิจที่น่าสงสัยเพียงหนึ่งกรณี สามารถกลายเป็นพาดหัวข่าวน่ากลัวได้อีกยี่สิบหัวข้อ จากนั้นข่าวเหล่านั้นก็ถูกคัดลอก แชร์ แปล โพสต์ซ้ำ ขยายความ และวนกลับมาใน Facebook จนดูเหมือนว่าครึ่งประเทศกำลังถูกบุกตรวจตั้งแต่ก่อนอาหารเช้า
และแน่นอน ทันทีที่ความกลัวเริ่มกระจาย กองทัพทนายความ ที่ปรึกษา “ผู้เชี่ยวชาญ” และพ่อค้าความตื่นตระหนกก็รีบกระโดดเข้ามาทันที
“ต้องรีบตรวจสอบด่วน”
“บริษัทของคุณอาจมีความเสี่ยง”
“ติดต่อเราทันที”
ช่างบังเอิญเหลือเกิน
พูดกันตรงๆ การปราบปรามเครือข่ายนอมินีผิดกฎหมายไม่ใช่เรื่องแปลก หากมีคนใช้ผู้ถือหุ้นปลอมเพื่อปกปิดธุรกิจผิดกฎหมาย หลีกเลี่ยงภาษี เปิดโรงแรมโดยไม่มีใบอนุญาต ซื้อที่ดินผ่านโครงสร้างบังหน้า หรือประกอบธุรกิจที่กฎหมายไม่อนุญาตให้ทำ เจ้าหน้าที่ก็มีสิทธิ์ตรวจสอบอย่างเต็มที่
แต่การนำเรื่องเหล่านี้มาสร้างความตื่นตระหนกให้ชาวต่างชาติทั่วไปที่มีบ้านอยู่ในประเทศไทย นั่นคือการขายความกลัว
การบังคับใช้กฎหมาย กับความตื่นตระหนก ไม่ใช่เรื่องเดียวกัน
ธุรกิจผิดกฎหมายบนเกาะ กับชาวต่างชาติที่อยู่ประเทศไทยมานานหลายปี จ่ายภาษี สนับสนุนครอบครัวไทย ดูแลบ้าน จ้างงานคนท้องถิ่น และมีส่วนร่วมกับชุมชน ไม่ใช่เรื่องเดียวกัน
มุมมองของผมง่ายมาก:
จัดการการใช้โครงสร้างผิดกฎหมายจริงๆ - เห็นด้วย
ตรวจสอบธุรกิจผิดกฎหมาย - เห็นด้วย
สอบสวนการหลีกเลี่ยงภาษี การถือครองบังหน้า และบริษัทนอมินีปลอม - เห็นด้วย
แต่หยุดทำให้เหมือนว่าชาวต่างชาติทุกคนที่มีบริษัทไทยเป็นส่วนหนึ่งของแผนอาชญากรรมขนาดใหญ่
ความกลัวขายได้
แต่ข้อเท็จจริงสำคัญกว่า
ก่อนที่ทุกคนจะรีบวิ่งไปหาทนายพร้อมเปิดกระเป๋าสตางค์ ลองหายใจลึกๆ ดูก่อนว่า “คดีจริง” ที่เป็นข่าวนั้นเกี่ยวกับอะไร แล้วแยกให้ออกระหว่างความเสี่ยงทางกฎหมายจริง กับข่าวคลิกเบตที่ถูกนำมารีไซเคิลซ้ำๆ
