T & C works hard to make sure we are up to date on legislative movements and laws. As part of that, we have an update about the different bills that were passed and not passed. The following information was received by the Apartment Association of New Mexico.

Legislative Recap:

The end has come in the First Session of the 56th New Mexico Legislature. A total of 1083 bills were introduced. There were 246 bills that passed both the House of Representatives and the Senate.

In the final days, there was a large push to finish the Budget Bill and Tax Package. The House of Representatives and Senate were able to come to an agreement on the $9.6 billion budget in the final days of the session. This represents an increase of roughly $1.2 billion more than current levels. The House of Representatives and Senate worked together during the final 24-hours and signed off on a $1 billion dollar tax package. This tax package should bring some financial relief to many New Mexicans.

Updates to industry relevant bills:

Did not pass - HB-6/SB-411 (Housing & Rent Changes) Duplicate bills of HB-65 from last year. A version of this bill was also proposed in 2021. HB-6 more than doubles the time for a non-payment of rent eviction. It extends both minimums and maximums. Most states are in the 3 to 7-day frame, as is New Mexico currently. However, at 10 days, we would be one of the longest and in a small minority. Under current law, the case may be continued once for a maximum of 7 days. HB-6 removes the restrictions on continuances. The case could go on forever if the judge thinks there is “good cause.” HB-6 extends claims for retaliation to include local ordinances which may be titled discrimination ordinances. This will include the recent ordinance by the City of Albuquerque which deems it illegal discrimination not to accept any rent assistance regardless of the requirements placed on the owner by the assistance program.
SB-411 died in the Senate Judiciary Committee and HB-6 died on the House Floor.

Did not pass - SB-99 (Rent Control Prohibitions) Repeals the Uniform Owner Resident Relations Code that prohibits political subdivisions and home rule municipalities from enacting rent control for privately owned real property.
SB-99 was Tabled by the Senate Health and Public Affairs Committee.

Did not pass - SB-375 (Rent Increases & Air Conditioning) Prohibits an owner from increasing payable rent over a 12-month period by more than 5% plus any increase in the federal Department of Labor’s Consumer Price Index (CPI) or plus the previous year’s increase in the CPI if unavailable for the current year. Prohibits an owner from increasing the payable rent over a 12-month period by 10% if the increase in the CPI plus 5% exceeds 10%. Obligates the owner or landlord to maintain cooling units in good and safe working order.
SB-375 was Tabled by the Senate Health and Public Affairs Committee.

Did not pass - HB-414 (Creating Housing Department) Creates and explains applicable measures for the Housing Department; provides details on powers and duties, designates the New Mexico Housing Trust Fund as a State Treasury Fund.
HB-414 was dropped from the calendar in its first committee.

Did not pass - HB-241 (Construction on Certain Dwelling Units) ) Prohibits a county, a municipality or the state from issuing a building permit for the construction of multifamily dwelling units consisting of twelve or more units where less than fifty-five percent of the total units are owner-occupied. AANM worked with the sponsor as the bill was supposed to be directed at condos.
HB-241 was Tabled in the House Consumer and Public Affairs Committee.

Passed - SB-381 (New Mexico Housing Trust Bonding) Passed both the House and Senate and has been signed by the Governor. This bill changes the 2.5 percent distribution to the housing trust fund from the severance tax bonding fund so that it begins in FY23 rather than in FY24. Last year, a bill was passed that appropriated recurring funding to the NM Housing Trust Fund, but the start date was not until 2024. This is a great win for affordable housing in New Mexico.


In total, AANM tracked 35 pieces of legislation in the 2023 Legislative Session. The Apartment Association of New Mexico and its Government Affairs Council would like to thank all of you that participated in this year’s legislative session. It was truly a team effort, and we are proud of the outcome.

Housing Solutions for all New Mexicans

February 2, 2023

As we work together for the successful future of our state, our communities, our neighbors, and our industry, it’s imperative that we continue the pressing conversation surrounding rent control. Senate Bill 99, which would repeal rent control prohibition, was tabled by a bipartisan vote in the Senate Health and Public Affairs Committee on Wednesday afternoon.

While it will likely remain tabled throughout the remainder of the 2023 session, we will continue to keep an eye on any movement. We remain solidly opposed to repealing the ban on rent control but stand ready to work with stakeholders to ensure housing for all.

When calculating solutions, we must first identify the root cause. The issue at hand is not the fault of hardworking local property owners; instead, it is a market-driven supply and demand issue. SB 99 doesn’t just ignore the causation; it exacerbates the situation by discouraging new development and causing supply to further diminish.

We want New Mexicans to thrive and have access to stable housing. In order to attain those outcomes, solutions must be supply-oriented and focus on addressing the varying needs of our diverse population. By working collaboratively with real estate industry professionals, stakeholders, property owners, renters, and our elected officials, we can meet in the middle to form solutions that will address the causation and create a more accessible housing market in New Mexico.

With this in mind, we have identified the following solutions:

Prioritize Making Homeownership Attainable for All
The rental market can be volatile and is tied to inflation, while homeownership offers stability and provides the opportunity for families to build generational wealth. We stand in support of measures to increase down payment assistance and resources to empower renters to become buyers. SB140 would provide $48 million in down payment assistance and incentivizes home ownership.
Expand the Emergency Rental Assistance Program (ERAP)
The statewide ERAP program assists both homeowners and renters with resources and bridging the gap in affordable rent and affordable property management. While this program has recently stopped taking applications, we advocate for the continuation and expansion of this program to better benefit all New Mexicans and increase access to housing.
Update Zoning Policies
The City of Albuquerque has proposed the Housing Forward Initiative, which will update zoning laws to address the housing crisis. We support this model and similar measures focused on removing the barriers to increasing the housing supply, and we encourage other municipalities to follow suit.
