📋 Landlords: If you're facing a small claims lawsuit and don't know what to expect, here's exactly how the process works.

First, you need to be properly served. This means an official proof of service, typically delivered by a sheriff, off duty officer, or a professional process serving company. Certified mail is technically allowed but courts view it as one of the weakest methods of service.

Second, and this is critical: you must appear in court. You cannot assume the case will go away on its own. You cannot assume no one will show up. Ignoring a small claims lawsuit as a landlord is one of the fastest ways to lose by default.

This is a real story. And if you have a home warranty on your rental, you need to read it.
We took over management of a property with a broken water heater. The tenant had no hot water, which is a health and safety issue that required us to issue a rent credit every single day the problem was not resolved.
The home warranty company took a full week to send someone out. When they arrived, they could not see an active leak so they refused to fix it. Our team had to physically go to the property, fill the water heater, and demonstrate the leak ourselves just to get the claim approved.
After all of that, the company still billed the owner for part of the replacement cost on top of the monthly premium and the service call fee.
Total damage to the owner: monthly premium plus service call fee plus partial replacement cost plus rent credit to the tenant.
A licensed plumber called directly would have solved the problem in 24 hours for less money.
Home warranties are not protecting your investment. They are slowing you down and costing you more.

If you're a California landlord planning to raise rent, there's a step that comes before the increase goes into effect — and skipping it can make an otherwise legal rent increase unenforceable.

California law requires landlords to give proper written notice before a rent increase takes effect. And the notice period depends on how large the increase is:

Raising rent by less than 10%? You must give your tenant at least 30 days written notice.
Raising rent by 10% or more? You must give your tenant at least 90 days written notice.

This applies to month-to-month tenants specifically — and it's one of the most commonly overlooked compliance steps we see landlords miss.

Here's why it matters: even if your rent increase amount is completely legal under AB 1482, failing to give the correct notice period can invalidate the increase entirely. You'd have to start the process over — which means more time, more paperwork, and a delayed income increase that could have been avoided.
