Big Shift Comes to Florida Real Estate and the rest of the US Real Estate Market.

Looking to buy or sell a home in Florida? Be advised: Starting later this week, the process is changing in some significant ways. Thanks to a settlement announced in March by the National Association of Realtors (NAR), buyers’ agents must now sign an agreement with prospective homebuyers upfront, clearly outlining their compensation. This information can no longer be included on multiple listing services (MLS), the databases that provide details about homes for sale. Prior to the $418 million settlement, home sellers were typically responsible for the 5% or 6% commission split between the buyer’s and seller’s agents.
Industry insiders suggest these new rules could favor more experienced agents, as buyers may be hesitant to sign an agreement with a less seasoned professional. Additionally, some estimates predict that commissions could decrease by as much as 50%.
The settlement still requires final approval, with a hearing set for November 26th.
📝 The new NAR settlement policy is now in effect and likely already impacting your market in Florida. Don’t panic—just keep these three points in mind:
1️⃣ You need an agreement with your buyer agent, but it doesn’t have to be exclusive or long-term. Negotiate the terms and shop for an agent you trust before shopping for a home. You may need to interview a few agents before finding the right fit, but this is time well spent.
2️⃣ Commission is negotiable, and now it’s written into the forms. Even though MLS doesn’t disclose the buyer agency compensation, it can still be negotiated in your sales contract. This holds true even if the seller isn’t proactively offering compensation.
3️⃣ Don’t forgo representation just to avoid fees—it could cost you more in the long run. Skilled buyer agents know your market and can not only negotiate a deal that works for you but also assist with due diligence tasks, helping you avoid costly errors in your transaction.
