Collections & Charge-Offs - Should you pay them?!

Before you start paying off old collections, it’s important to know your rights. Here’s a quick breakdown of how long creditors have to sue you in Georgia:

📝 Written Contracts – 6 years
– Includes signed agreements like installment loans or leases
– Time starts from last payment or when you defaulted

🗣 Oral Agreements – 4 years
– Verbal promises without written proof
– Time starts from the last payment or when the agreement was broken

📄 Promissory Notes – 6 years
– Includes car loans, private loans, etc.
– Clock starts from the due date or last payment

💳 Open-Ended Accounts – 4 years
– Credit cards, lines of credit, etc.
– Time starts from your last payment or charge

💥 Now, let’s talk about Collections & Charge-Offs

Here’s what you need to know:

🔹 Old debts (6-7 years) may be close to falling off your credit report. Paying them doesn’t always improve your score—it can actually re-age the account and hurt you.

🔹 Focus on newer collections first. These have the biggest impact on your score.

🔹 Negotiate no more than 30% of what you owe

🔹 Ask for a “Pay-for-Deletion” letter – this is when a collection agency agrees to delete the account from your credit report once you pay. Get it in writing before sending money! If they suggest a payment plan, do not accept and DO NOT give them your credit card information.

If they won’t delete it — don’t pay it. It’ll still show up on your report as “paid collection,” which doesn’t help much.

You can then write a letter to dispute, if you want. But if it's your debt, then it's your debt. It will not be deleted off of your report unless it is inaccurate. It’ll stay unless it’s past 7 years. Plus, if you are looking to buy a home soon, you would have to get the "Dispute" label off of your credit report on items more than $1,000.

✅ But before touching collections... focus here first:

🔸 Are you below 30% on your credit card balances?
🔸 Are you paying all your bills on time?
🔸 Are you avoiding new credit applications?

Let’s talk credit — because a lot of people are struggling right now.
Student loans are hitting hard and dragging credit scores down. I get it. But here’s the good news: it doesn’t have to stay that way.

I’ve been on this journey myself and now that my credit score is over 700, I want to use what I’ve learned to help others reach their goals too.

Here’s how you can start improving your score today:

🚫 Don’t waste time or money on:

-Credit Karma

-Kikoff

-Paid “credit fix” services

🔍 Instead, go to AnnualCreditReport.com and download all three reports for free. Take a real look at what needs improvement.

If you need help, I’ll gladly review it and give you a solid plan to improve your score — no charge at all.

✅ How to Improve Your Score:

-Pay down your debt gradually from smallest to largest

-Keep credit utilization under 30% — ex: $1,000 limit = stay under $300

-Maintain a good credit mix: 1–2 credit cards, auto loan, personal loan, etc. (in good standing)

-Limit hard inquiries — only apply when necessary

-Keep your oldest credit card open to show long-term credit history

🔒 How to Maintain It:

-Don’t apply for credit you can’t afford

-Pay every bill on time

-Only charge what you can pay off in full each month

🏡 FHA Collection Guidelines Simplified:

Ever wondered if you should pay collections or if lenders look at them when applying for a mortgage? Here is some information I'm sure you have never heard before.

🚫 No Requirement to Pay Off Collections:
FHA doesn't mandate paying off collections for mortgage approval.

🔍 Lender Discretion:

Credit derogatories are at the LENDER's discretion, potentially affecting Debt to Income limits, credit score requirements, or triggering collection payment conditions.

💰 Threshold for Action:
If total collection balances exceed $2000 (non-medical, Federal, or support debt), action may be needed.

💡 Example:
Scenario: You have $14,000 in collections (closed and open with balances). Could be Auto-related, personal loans, debt collectors, anything non-medical. Guess what, Charged off collections do not matter!

Action Steps:
Include 5% of the total collection balance in DTI ($700/month).
Alternatively, qualify with lower payment amount of an approved repayment plan.

If you paid off all collections now, your credit score should improve within 30 to 60 days depending on when the collections report back to the credit bureau.

1️⃣ Check Your Bank Summary:
Take a peek at your bank summary for 2023. See where your money is flowing - every dollar, every category.

2️⃣ Expenses vs. Income:
Compare your expenses to your income. If you're seeing more dollars flying out than rolling in, it's time for a closer look.

3️⃣ Identify Spending Hotspots:
Discover those spending hotspots! For me, it was a jaw-dropping $5k in Food and Drinks and another $5k in Groceries. 😱 If I planned right, I could had over $10k saved!!! 🤦🏾‍♀️
