Exterior complete: stucco finished, and the building now has its final facade. Interior finishes are underway, with LVT flooring, door hardware and trim, and bathroom finishes and mirrors installed unit by unit. Common areas and systems are progressing too, with drywall finishing in the lobby, ceiling fans going up, and electrical trim-out advancing toward final commissioning.

From major construction to final finishes, the project remains on schedule, generating local jobs at every stage.

This is one of the most significant milestones an EB-5 project can achieve under the Reform and Integrity Act.

An I-956F approval means USCIS has completed a comprehensive review of the project, including its business plan, economic impact, job creation methodology, offering documents, securities compliance, and High Unemployment Area (HUA) qualification.

For investors, this represents greater confidence in a project that is already moving forward—not just on paper, but in reality.

If your EB-5 project succeeds, who gets paid first: you or the developer?

The answer depends on how your investment is structured.

There are two ways your EB-5 capital can be deployed:
Loan: You lend money to the project.
Equity: You own a share of the project.

Whether your investment is structured as a loan or equity, the bank is repaid first if the project is sold.

With a loan structure, however, a successful project doesn't necessarily mean you'll get your money back right away. The developer may choose to extend the loan instead of repaying investors.

While the New Commercial Enterprise (NCE) has the authority to approve a loan extension, in practice, the Regional Center usually controls that decision—not the investor.

In an equity structure, the alignment is different. The developer doesn't earn profits until investors are repaid under the operating agreement. Their incentives stay aligned with yours.

That's why BAI Capital structures its EB-5 offerings as equity rather than debt. We believe aligning the developer's incentives with our investors creates a stronger long-term investment structure.
