County Downe residents Pennsylvania Office of Attorney General: These Dangerous Potholes Have Been Here for 6 Months — We Need Answers NOW!

Please look at these photos. Our community roads have severe alligator cracking and a large pothole filled with water and debris. This has been like this for at least 6 months. How much longer do we have to wait before someone gets hurt or a car is damaged?

We have serious questions that demand immediate answers:

• Why has this pothole and the widespread road damage not been repaired after 6 months?
• Does the HOA not have the money? What happened to the reserve fund? What is the current balance?
• Where are the independent audits for the last 4 years?
• When is the election finally happening? (It was supposed to be last December — nominations closed end of April and we still have no update.)
• Full update on the lawsuit against Sunesh Patel
— show us the detailed receipts and accounting for all legal fees spent.
• What is the current status of the pool repairs and when will it reopen?
• Given the ongoing maintenance failures on roads, grass, sidewalks, and the pool — will the board finally reduce our fees until services improve?

Many homeowners are concerned that our fees are not being used to maintain the community we pay for. We have the right to this information under our governing documents and Pennsylvania law.

Take action today: Send a written demand (email + certified mail) to the board and management company requesting a special community meeting and full transparency on the reserve fund, audits, lawsuit accounting, election timeline, and pool status. These are legitimate questions protected by the First Amendment.
If the board continues to ignore homeowners, we also have the right to file complaints with the Pennsylvania Attorney General’s Office:

County Downe Homeowners: Election Update Needed After 5 Months

Fellow neighbors and ,

It has now been 5 months since the HOA board election was originally scheduled for December 2025. Nominations closed at the end of April 2026, yet many residents still have not received any official communication regarding the status of the election, the number of candidates, or a revised date.

This prolonged delay without clear updates raises legitimate questions about the election process and timely communication from the board.

We respectfully ask the board to provide answers to the following:

• Why has the election been delayed for 5 months?
• When will the election now be held?
• How many nominations were received by the end of last month, and what is their current status?
• When will the board schedule a community meeting to give homeowners a full update on the election timeline and other important matters?

Homeowners have the right to timely elections and transparent governance in accordance with the association’s governing documents. Clear and prompt communication helps maintain trust and ensures proper representation for our community.

These questions are submitted in good faith and concern matters of public interest to all homeowners. They are protected under the First Amendment.

I encourage every resident who shares these concerns to send a polite, written request to the board and property management company asking for an immediate update and the prompt scheduling of a special community meeting.

Fellow neighbors Concerned Residents of County Downe,

Many residents are concerned that our HOA board may be misusing our fees to fund personal cease-and-desist letters aimed at silencing homeowners who speak out.

This raises serious questions about the misuse of association funds and potential retaliation against residents exercising their First Amendment rights.

Key issues we deserve answers on:
• Why has the pool stayed closed for years?
• Are we facing financial trouble? Show us the numbers!
• Why are roofs, roads, sidewalks, curbs, basketball courts & common areas being neglected?
• Where exactly are our HOA fees going?

🚨 URGENT: County Downe HOA Lawsuit Update – Homeowners DESERVE Answers NOW!

Hey neighbors and Concerned Residents of County Downe,

The HOA (hired by Neal Sampat’s law firm since December 2023) is still dragging out a baseless lawsuit against me, Sunesh Patel. I’ve turned over every single account, receipt, and document proving my innocence — yet they keep spending your money.

Here’s the truth they don’t want you to see:

• HOA has already burned close to or over $50,000 on this witch hunt.

• Are you ready to pay another $100,000+ in legal fees for a fight that does NOTHING for our community?

This lawsuit is killing us:

• HOA insurance has nearly doubled — from $115,051 in 2022 to $227,000 now (a 97% increase).

• That means higher dues for every single homeowner.

• Pool is closed for 2 years or forever!!!

• Roads desperately need repaving.

• Snow removal, landscaping, and trash costs are rising.

• Property values are dropping because of the drama and endless spending.

I’m Sunesh Patel and I’m ready to spend whatever it takes to clear my name. But this isn’t about me — it’s about your money and your homes.

Demand a full meeting with the Council and a complete lawsuit update NOW.

Neighbors — I’m posting this to keep everything transparent, factual, and focused on governance.

Per our HOA Bylaws, our annual board election is supposed to be held in December. It is now almost the end of January, and the Board has not held the election and (to my knowledge) has not provided a written, bylaw-based explanation for the delay or a confirmed rescheduled date.

This isn’t “drama” — it’s basic HOA compliance. When elections aren’t held on time, it can create serious bylaw violations and risks for the Association, including:

Failure to follow the governing documents (election timing, nomination process, meeting and notice requirements).
Reduced legitimacy of board actions taken after the term should have ended (homeowners can question whether the Board is properly seated/authorized).

Lack of transparency and accountability (homeowners lose their scheduled opportunity to vote and replace directors).

Potential notice/meeting violations if the annual meeting wasn’t properly called, noticed, or conducted as required by the bylaws.
Entrenchment concerns (delaying elections can look like an attempt to stay in power without a vote—whether intended or not).

I am requesting the Board immediately do the following:
Publish the election date (within the next 7–14 days).

Provide the bylaw section the Board is relying on for any delay (if there is one).

Open nominations (and confirm eligibility requirements).
Provide written election procedures (ballots/proxies, quorum requirements, vote counting, and who will certify results).

Commit to a neutral process (independent inspectors/volunteers to count votes, with results announced the same day).

This post is not meant to attack anyone personally. It’s about the Board following the rules that apply to all of us.

As many of you know, the street lights on Juniper and Inkberry Lane have been completely out and only few are on since December 28, 2025.

It has now been over a week of total darkness in these areas, and there has been zero communication from the Board regarding a fix, a timeline, or even an acknowledgment of the issue.

We all pay our dues with the expectation that the HOA will maintain the common elements and ensure our community is safe. Leaving major streets unlit for this long is not just an inconvenience; it is a serious safety hazard and a breach of the Board’s fiduciary duty to maintain the community.

To the Board: Please be advised that ignoring a known safety hazard constitutes negligence. Under Pennsylvania law, while board members generally have protections, those protections can be stripped away in cases of willful negligence or failure to address known dangers.

If a resident, child, or guest is injured due to this lack of lighting (tripping, vehicle accident, or security incident), we will look to hold the Board members personally responsible for those damages, as this is no longer a "maintenance delay" but a refusal to address a known dangerous condition.

We need an answer immediately:
When was the repair scheduled?
Why have we not been notified?

Hey neighbors! 🏡 As homeowners, we all pay into our HOA to ensure our community is safe, beautiful, and well-maintained. But what happens when the HOA fails to hold up its end of the bargain? This is known as HOA negligence.

What are the HOA's basic duties?

Your HOA has a "fiduciary duty" to act in the best interests of the community. This includes:
* Maintaining Common Areas: Keeping pools, parks, elevators, and clubhouses safe and in good repair.
* Managing Finances: Using HOA funds responsibly for the benefit of the community.
* Enforcing Rules Fairly: Applying the community rules and covenants consistently to all residents.

What does HOA negligence look like?

Negligence occurs when the HOA breaches its duty, and that failure causes harm or damage. Some common examples include:
* Failing to fix a broken security gate, leading to a theft.
* Not repairing a leaky roof in a common area, causing water damage to your unit.
* Ignoring a dead tree that later falls and damages property.
* Failing to address a known hazard, like a broken stair or icy sidewalk.

What can you do?

If you believe your HOA is being negligent, you have rights!
* Document Everything: Keep detailed records of all communication, take photos/videos of the issue, and save any related receipts.
* Submit a Formal Written Complaint: Send a certified letter to the HOA board detailing the problem, the HOA's duty to act, and what you expect them to do.
* Attend Board Meetings: Raise your concerns publicly during an HOA meeting. There is strength in numbers if other homeowners are facing the same issue.
* Review Your HOA's Governing Documents: Your CC&Rs (Covenants, Conditions, and Restrictions) will outline the HOA's specific responsibilities.
* Seek Legal Counsel: If the HOA still fails to act, you may need to consult with an attorney who specializes in HOA law to understand your options for taking legal action.
