Zillow is in a heap of trouble y’all, agent licenses may be at stake and or fined: here’s what I’ve researched:
Recent Zillow Class Action Lawsuits
• 1. RESPA/Anti-Kickback Allegations and Steering to Zillow Home Loans (ZHL):
• This is a central focus of the Taylor v. Zillow and Armstrong v. Zillow cases, which were recently merged into a single, consolidated lawsuit.
• Allegation: Zillow allegedly violates the Real Estate Settlement Procedures Act (RESPA) by pressuring or incentivizing real estate agents in its Premier Agent and Flex programs to steer homebuyers to its in-house lender, Zillow Home Loans (ZHL). Agents who meet ZHL referral quotas are allegedly rewarded with more or higher-quality customer leads (a form of illegal kickback).
• 2. Deceptive Practices and Hidden Agent Fees/Commissions (RICO Claims):
• Often overlapping with the above RESPA cases (the consolidated case includes these claims), this focuses on Zillow's relationship with buyers and agents.
• Allegation: Zillow allegedly "tricks" buyers who click "Contact Agent" or "Request a Tour" into being routed to a Zillow-affiliated Flex agent, who is then required to pay a large referral fee (up to 40% of their commission) to Zillow. This fee is allegedly hidden from the consumer, who may mistakenly believe they are contacting the listing agent. This is claimed to be a fraudulent scheme that unlawfully maintains high, inflexible commissions and inflates home prices.
• 3. Securities Fraud (Zillow Offers iBuyer Business):
• This is a historical class action lawsuit relating to Zillow's now-shuttered "Zillow Offers" house-flipping business.
• Allegation: Investors claimed Zillow misled them about the risky nature of its iBuying program, specifically by concealing the "drastic and risky actions" of applying large overlays on top of its pricing algorithms to inflate purchase offers, ultimately leading to massive losses when the business was shut down in November 2021.
• 4. Rental Listing Antitrust (FTC and State Attorneys General):
• While not always a consumer class action, Zillow has been sued by the Federal Trade Commission (FTC) and multiple State Attorneys General for antitrust and anticompetitive practices in the rental market.
• Allegation: Zillow allegedly made an agreement with a rival company (Redfin) to exit the online apartment rental listings market, which the FTC claims suppressed competition, innovation, and led to higher costs for renters and property managers.
