🏡 Congratulations H & T on closing escrow on your beautiful Berkeley Hills home! One of the best things about being a Realtor is handing over keys to your clients and watching the joy in their smiles as they walk through the door for the first time as the new homeowner.

🏡 Understanding Easements in California Real Estate
An easement in California real estate is a non-possessory legal right that allows an individual or entity to use a specific portion of another person's land for a particular purpose. It does not grant ownership, but rather a limited right to utilize the property, and this right is generally permanent, often "running with the land" through changes in ownership. The property that benefits from the easement is called the dominant tenement, while the property that is burdened by it is the servient tenement. The most common types of easements encountered by California property owners are utility easements, which grant access to utility companies for maintenance of power, water, or gas lines, and access easements (or right-of-ways) that allow a neighbor to cross the property to reach a public road or their own land. Easements are typically established through written agreements, often recorded in the property deed, but they can also be created by necessity, implication, or even through long-term, unpermitted use, known as a prescriptive easement.

Because an easement impacts how a property can be used and developed, it is a critical factor for both buyers and current owners in California. Knowing the type and scope of any easement is essential, as it may restrict the property owner from building, planting, or placing structures within the easement area to ensure the easement holder’s access or use is not obstructed. For example, a driveway serving a back lot that crosses a front property would be an express easement, clearly defining the rights of passage. Disputes often arise when the terms of an easement are unclear or when an owner attempts to interfere with a neighbor's right of use. Therefore, a thorough title search during a real estate transaction is necessary to uncover all existing easements, ensuring a clear understanding of the limitations and obligations tied to the land.

The Albany, CA real estate market continues to be highly competitive, despite a notable scarcity of available homes. As of November 2025, the Total Active Listings stand at an exceptionally low number of 7 homes, indicating a severe constraint on inventory. This tight supply environment contributes to the market's high competitiveness, where homes are frequently selling for significantly over the asking price. For example, the median days on the market was a short 15 days, and the average sale-to-list price ratio was as high as 121.6%, with nearly 89% of homes selling above their original list price.
While the market remains seller-favored due to low inventory and high competition, there are mixed signals in pricing metrics. The median sale price per square foot has seen a yearly increase, up 9.3% from the prior year. However, the overall median sale price has dipped to $1.035 million, representing a 9.21% decrease year-over-year as of September 2025 data. This suggests that while demand is intense for the few homes available, the market is undergoing a complex phase of value adjustments, with fewer homes (9 sales in September, down 30.8% YoY) closing compared to the previous year.

While the winter months from December to February mark the slowest period for the real estate market due to holidays and cold weather, a significant number of homes—over 11,300 existing and 1,600 new homes—are still sold daily, on average. This off-peak season offers unique advantages for both buyers and sellers. Sellers face less competition and can utilize modern real estate technology, such as virtual tours and online platforms, to showcase their homes effectively despite poor weather, making winter selling less difficult than in the past. When preparing for showings, sellers should focus on maximizing lighting and using simple, non-overpowering holiday decor, while recognizing that winter buyers are typically more serious and motivated, often working against a strict deadline.

For buyers, the winter market presents a chance to inspect a home's energy efficiency when the weather is at its worst, allowing them to evaluate insulation, the furnace, and other essential systems. Although inventory is lower, buyers benefit from less competition from other prospective buyers and gain more negotiating power, as sellers may be more motivated and willing to offer discounts or flexible terms. Furthermore, closing a home purchase by December 31st can potentially allow buyers to claim tax deductions for property taxes and mortgage interest.
