🏠 New Tax Alert for Out-of-State Property Owners in Massachusetts!

📅 Effective November 1, 2025

If you live outside Massachusetts but own property here, a new state rule may affect you when you sell.

👉 Starting Nov 1, 2025, Massachusetts will require withholding tax on property sales of $1 million or more made by nonresidents — including second homes, vacation properties, and investment real estate.

🔹 Option 1 — Net Gain Method (recommended):
If you file the Transferor Certification form before closing, the state will withhold 5% of your actual gain (profit) — not the full sale price.

🔹 Option 2 — Gross Sales Price (default):
If no form is filed, withholding is 5% of the total sale price — which can be much higher.

💡 Example:
Sell for $1.2M, profit $350K →
• Net Gain Method = $17,500 withheld
• Gross Price Method = $60,000 withheld
That’s a $42,500 difference!

✅ Tip: File the certification early, keep your cost records, and talk to your closing attorney or tax advisor to avoid over-withholding.
