🏗️ **Toms River Waterfront Battle Heads Back to Court**

The legal fight over the future of downtown Toms River is far from over.

Earlier this year, Superior Court Judge Sean D. Gertner ruled that the Township acted unlawfully when it repealed redevelopment plans covering portions of the downtown waterfront. The repeal passed by a 4–2 vote, but a valid protest petition filed by affected property owners required at least five votes.

Now, Meridia Toms River 40 Urban Renewal LLC—the developer proposing apartments, retail space and affordable housing near the former Red Carpet Inn property—is asking the court to rule that the Township’s actions also violated its civil rights.

Toms River argues that an incorrect legal procedure does not automatically amount to a civil rights violation. Township officials maintain that they acted under what they believed was a reasonable interpretation of the law.

Judge Gertner is scheduled to hear arguments on **September 18**.

A ruling for Meridia would not automatically approve construction of the proposed six-story waterfront development. However, it could leave the Township responsible for damages, attorney’s fees or other court-ordered relief.

Several separate issues remain unresolved, including whether Meridia defaulted on its redevelopment agreement and how the proposed affordable-housing component may affect the project.

This hearing will not determine exactly what gets built. It will decide whether Toms River’s unlawful repeal was simply a legal mistake that has already been corrected—or whether it crossed the line into a civil rights violation.
