IF YOU ARE PROSTESTING YOUR TAXES PLEASE READ ALL OF THIS POST:

I have been sending comparable sales to more cabin and property owners than I can count. I have a little story for you!

My clients' cabin is a one bedroom, one bath, 877 SQ FT that was built in early 2024. The tax assessor assessed this cabin in 2023 at $110,00 to a fair market value of $810,323 in 2024. (WTH?) I pulled all one bedroom cabins that sold in 2024 off the OKCMAR MLS (most accurate way of finding comparable sales and 2024 values) that were built in 2023 or 2024, similar square footage and finish outs. There are 14 similar cabins sold in 2024. The average sales price of these new, 1 bedroom cabins were $470,362. The average sold price per square foot of these similar cabins is $463.19 SQ FT. That means if the subject cabin was sold in 2024 it most likely would have sold for very close to $406,217....NOT $810,323.

Tell me how ANY new 1 bedroom cabin should be assessed higher than the most expensive cabin that sold in 2024 for $600,000 much less for $810,323? How is Bruce Short coming up with these values? Inquiring minds want to know.

Email from Bruce: "Your taxes will only increase 5%. It doesn't matter IF your Fair Market value went to $10 Million dollars, your taxes will only increase 5%." - I trust his word, don't you?

PLEASE REMEMBER THIS WHEN YOU ARE PROTESTING: DO NOT FALL FOR THIS ARGUMENT AND PLEASE PROTEST YOUR FAIR MARKET VALUES.

What happens if OK law changes and at some time in the future the 5% cap increase is removed and you are now taxed at this wildly incorrect fair market value? This happened in Dallas County and taxes went up more than 30% in one year! So protest your fair market values until they are correct.

Have questions about filling out the protest form? Call the tax assessor's office at 580-286-5272 or email [email protected].

***Do not assume that once you send in your protest you are good. If you don't hear back from their office your protest may have been completely disregarded. The assessor's office will not let you know if they did not accept your protest letter so please follow up.

Once you receive comparable sales from your favorite realtor and you have protested, do not settle for the assessor's office new assessment of "meeting in the middle" between their assessed fair market value and the fair market value you and your realtor or your estate professional thin it should be. You need to appeal your protest to the County Board of Equalization within 15 calendar days of the date you received the decision. Please go to tax.ok.gov and download for 976 to file your appeal against your protest.

Bad news for McCurtain County land owners. The apology "mistake letter" Bruce made public has disappeared. When you call the tax assessor's office the deputy assessor will tell you Bruce sure did not make any mistake. (Not true). There is no letter of his mistake. (Not true) Assessments will not be corrected, and new assessments will not be mailed out. Everybody has 30 days after March 28th to send in their protest. County Assessor Informal Protest Form 974 at tax.ok.gov

Every single landowner needs to contact an appraiser, contact a realtor or somehow pull comps for yourself for sales that happened in 2024. Everybody needs to protest their taxes. You absolutely must fill out the form perfectly or it will be discarded.

From the people that I have pulled comparable sales for that have already protested are still getting inaccurate new assessments back. If you are given comps from a realtor and the assessor does not agree to the "Fair market value" the realtor or appraiser is providing you, you need to appeal to the County Board of Equalization. You have 15 days after receiving your new evaluation to make the appeal. Please fill out form 976 available from the county assessor's office. Please Contact the tax assessor's office for detailed information on how to appeal.

Bruce Short I have asked these questions to you multiple times and you have been silent.

1. In light of your mistake of accidentally increasing nearly everyone’s land values in McCurtain County 200-300%, are you going to reassess all “Current Year 2024 Fair Cash (Market) Values”, “Assessed Values” and “Estimated taxes”? . Yes or no?

2. Are you going to then send out new reassessed “Notices of Increase or Decrease in Valuation of Real Property” for 2024? Yes or no?

3. Then are you going to extend everyone’s time limit to protest past the 30 calendar days which started March 28th? Yes or no?

You have also stated in a text message, "There are several ways taxes are increased more than 5%. A sale, added improvements, or a lawsuit against the county." "If someone suits (sues) the Sheriff or jail for wrongful death and so forth and (a) lawsuit against the county that goes in the favor of the plaintiff that exceeds $500,000." Can you explain that please? Do you get to pick and choose who is taxed more than 5%? Clearly this increase in tax rate isn't being applied to everyone, just some. Why?

In 2013 Bruce Short paid $1,000 for 110 acres in McCurtain County, near the Red River. For 11 years Bruce paid $0 in taxes and the "fair market value" of the land was also $0. For the tax year of 2024 his 110 acres has a fair market value of $17,675 which is worth exponentially more than that. His assessed value of the land is $1,944. He will pay a whopping $161.94 in taxes on this land for the first time in 11 years! How is it that Bruce Short didn't "accidently" make the same mistake on his property that he did for thousands of cabin owners by assessing his land 200-300% higher than it's actual value? It's good to be king and sucks to be a cabin owner at his mercy.

Unlike the weather, the Hochatown market is warming up. I’m not sure who said the last quarter of 2024 was slow because Hochatown alone had 81 properties sold.

I sure was busy! From September to December, I sold 19 of the 81 properties - for a total of $16,500,000.
