Every realtor has had buyers go silent after months of work. We've calmed sellers down at midnight when everything felt like it was falling apart. We've fought hard at the negotiating table, and we've watched deals die the day before closing after pouring everything into them.

The first question in selling a parent's home almost always comes down to this: who has the legal authority to do it?

It sounds simple. It often is not.

A Power of Attorney may give a child the authority to sell real estate on a parent's behalf, or it may not. A home held in a trust passes authority to a successor trustee. A home that typically goes through probate follows a different path entirely.

Getting this wrong late in the process, after a buyer is already under contract, creates real problems.

If you are thinking about getting your documents in order, or if a parent's situation is changing and you are starting to think ahead, an elder law attorney is the right first call.

The earlier this gets sorted out, the easier everything else becomes.

Selling a parent's home is rarely just a real estate transaction.

Even when the decision is clear, even when everyone agrees it is time, the process often brings up more than families expect. Old dynamics surface. Emotional weight catches people off guard. What feels like a simple decision on paper feels very different when you are standing in the house.

I see this regularly. And I think it is worth naming.

The families who move through it most gracefully are usually the ones who gave themselves permission to feel the weight of it, communicated openly, and did not try to rush past the emotional parts to get to the practical ones.

The practical parts are manageable. The legal questions have answers. The house will sell.

But the process deserves the same patience and care you would give anything else that matters.
