All buyers looking to purchase any residential property MUST sign a โBuyer Representation Agreementโ before walking into a property.
Read that again, โMUST sign a โBuyer Representation Agreementโ before walking into a property.โ Not doing so could remove the Agent and Brokerage from the umbrella of the settlement. This could be grounds for termination of licensure.

Starting August 17th, no REALTORยฎ will be able to unlock a door without you first signing the agreement. This is non-negotiable and is part of a legally binding settlement for all REALTORS. Doing so violates the settlement and removes that Agent and Brokerage from the settlement umbrella.

The Buyer Representation Agreement is a contract between you, as the Buyer, and your REALTORยฎ. It outlines the details of your relationship, roles and responsibilities, and the REALTORโs compensation. The compensation/commission stated is the MAXIMUM amount your broker/agent can receive from the transaction. We can make this for one single home/property, a list of homes/properties, and/or for a region that you are looking for a home or property.

The agreement states that the Buyer is responsible for commissions; however, there are situations where others, including the Seller (Concessions) or the Listing Broker (Co Brokerage), may contribute to this fee/commission too. Historically, Sellers paid the Listing Broker a commission, which was then shared with the Buyerโs Broker (Co Brokerage). However, not all parties across the nation did this the same (Arkansas was doing so, thus not a big change here - simply more clarification) and this also led to a misunderstanding that โThe Seller pays the Buyerโs Agent,โ which isnโt entirely accurate. This misconception resulted in a class-action lawsuit, driving these changes. With the new NAR settlement, Agents/Brokers cannot advertise ANY compensation via the MLS, meaning Buyerโs Agents arenโt guaranteed compensation like before.
