HUD has some new rules
Effective January 13, 2025, HUD requires owners of5 public housing and Project-Based Rental Assistance (PBRA) projects to provide a 30-day notice before filing an eviction for non-payment of rent. This rule mandates detailed, written notice outlining the amount owed, how to cure the violation, and how to request income recertification.
Key Details of the New HUD Rules (2025)
30-Day Notice Rule (Effective Jan 13, 2025): Tenants in public housing and PBRA must receive 30 days' notice before an eviction for non-payment is filed.
Notice Requirements: The notice must include an itemized breakdown of rent owed, the date by which it must be paid to avoid eviction, and instructions on how to rectify the non-payment, including options for income recertification.
Excluded Programs: The Housing Choice Voucher (HCV/Section π, Project-Based Voucher (PBV), and Rental Assistance Demonstration (RAD) programs are not subject to this specific 30-day notice rule.
HOME Program Rule (Effective Feb 5, 2025): The HOME Investment Partnerships Program is updated to require written leases (minimum one-year term), strengthened tenant protections, and standardized procedures for lease termination or non-renewal.
HOTMA Implementation (Delayed): The deadline for full compliance with the Housing Opportunity Through Modernization Act (HOTMA) income and asset documentation standards was extended to January 1, 2027.
These changes aim to strengthen tenant protections, ensure due process, and provide more transparency for renters in federally assisted housing.
