An encroachment occurs when a structure or improvement extends onto someone else’s property. It could be a fence built over the property line, a neighbor’s shed that crosses the boundary or even part of a garage, driveway or other improvement.
These issues can complicate property ownership and may need to be addressed when a home is bought, sold or refinanced.
That’s another reason the work done before closing matters. Title professionals review information affecting the property and help identify issues that could impact a buyer’s ownership rights. Depending on the transaction, a survey or other property information may reveal boundary or encroachment concerns that need attention.
And while an owner’s title insurance policy may provide protection against certain covered matters involving encroachments or boundary issues, coverage depends on the policy, endorsements and circumstances of the claim. Ask you title company if you have questions about coverage.
