Under Connecticut law (C.G.S. § 47a-20), a landlord cannot legally refuse to renew a lease or evict a tenant in retaliation for reporting code violations or requesting repairs for a habitable living environment. Reporting mold falls under this protection. [1, 2, 3, 4, 5]
Key Legal Protections for CT Tenants
The 6-Month Window: Retaliation is presumed if the landlord takes action (like a non-renewal or rent increase) within six months of your repair request or complaint to authorities. [1, 2]
The Retaliation Defense: If the landlord initiates a formal eviction (summary process), you can raise retaliation as a legal defense in Housing Court. [1]
Landlord's Rebuttal: A landlord can only rebut the presumption of retaliation if they can prove they had a legitimate "non-retaliatory" reason, such as tenant non-payment of rent, lease violations, or a desire to make major repairs that require the unit to be vacant. [1, 2]
