It seems like EVERYONE is talking about the new Real Estate Commission guidelines and the lawsuit. As a whole, this is really not going to change much in the industry. There are other states where exactly what this lawsuit has settled on, is already doing. So, here are the quick facts. PM me if you want me to elaborate.
-- Instead of the listing broker offering a commission to whomever brings the buyer, the seller now must do that. That will be done through a Buyer's Agent Compensation Agreement that the listing agent will sign with the sellers. What this means is that the seller will still pay for a buyer to come to their house and be represented, it is just worded differently.
-- Buyers MUST sign a buyers agency agreement when they meet with an agent. This will just state that the agent represents the buyer, and what the fee will be. If the seller is not offering a compensation to bring a buyer, then the buyer and agent can negotiate the fee.
So, that is about it. The news has portrayed this as some major change, but it really is not. If you want to sell your home quickly and for the highest amount, then you are still going to be paying about the same amount. Prices are not going to change, there isn't going to be some major uproar, just a few minor tweaks.
