Did You Know? — The Association’s Attorney

When you hear that an Association has an attorney, it's important to understand who the attorney represents and how they work with the management company.

The Association's attorney is typically hired to represent the Association as a whole—not simply the Board and never the management company.

They often assist with:

āš–ļø Collection Matters

Helping the Association pursue unpaid assessments and other collection matters in accordance with the governing documents and applicable law.

šŸ“‹ Legal Guidance

Advising the Association on governing documents, compliance, contracts, and other legal matters.

šŸ¤ Coordination With Management

The attorney and management company work together to obtain records, provide information, and carry out decisions made by the Board.

šŸ  Protecting the Association
The attorney's role is to provide legal guidance that helps protect the Association and its interests.

One important distinction:

The Association's attorney is not an agent of the management company.

Management and legal counsel are separate professionals with different responsibilities—but effective communication between the two is essential to properly serve the Association.

We Moved — And We’re Saying Thank You. šŸ’™

Tomorrow, September 1st, marks an exciting new chapter for William Douglas Management as we officially move into our new Charlotte headquarters.

And while we’re incredibly excited about the new space, we know this moment isn’t really about a building.

It’s about the people who helped us get here.

To the Boards and homeowners who have trusted us to serve their communities — thank you.

To our vendors and industry partners who work alongside us every day — thank you.

To our leadership team for believing in our people, investing in our future, and continuing to push us forward — thank you.

And most importantly, to the William Douglas team — thank you.

Our staff is what makes William Douglas what it is today. Their dedication, relationships, hard work, and commitment to the communities we serve are the reason we continue to grow.

A new office is exciting. But needing a new office because we’re growing? That’s something worth celebrating.

And we know that growth didn’t happen by accident.

It happened because you grew with us.

It's a question many homeowners ask—and one that's often surrounded by misconceptions.

HOA assessments aren't optional contributions; they're what keep a community operating. They help fund landscaping, amenities, insurance, repairs, common area maintenance, and so much more.

When an account becomes delinquent, there is typically a collection process that the Association is obligated to follow. Depending on your governing documents and applicable state law, that process may include late fees, interest, suspension of amenity privileges, collection efforts, a lien, legal action, and, in certain circumstances, foreclosure.
The goal isn't to punish homeowners—it's to protect the financial health of the entire community and ensure that all owners are treated fairly and consistently.

If you're experiencing financial hardship, don't wait. Reaching out to your Association or management company early may help you understand your options before additional fees and legal action become necessary.

What is a Special Assessment?

A special assessment is an additional charge approved by an Association when the regular budget and assessments aren't enough to cover an unexpected, significant, or one-time expense.

So when might an Association need one?

šŸ  Major repairs or replacements
A roof, pool, clubhouse, road, or other common element may require an expense that wasn't fully funded in the regular budget.

šŸŒ§ļø Unexpected damage
Storm damage or another unforeseen event can create costs that exceed what the Association has available.

šŸ’° Insufficient reserves
If an Association hasn't accumulated enough reserves for a major project, a special assessment may be necessary to help fund it.

šŸ“ˆ Unexpected cost increases
Significant increases in insurance, utilities, construction, or other expenses can sometimes create a financial shortfall.

A special assessment isn't necessarily a sign that an Association is being poorly managed. Sometimes unexpected expenses happen.
