Agents are inventing loopholes to boost their commissions higher than ever. From the linked story: "Multiple local agents were granted anonymity by the Review-Journal to protect them from industry retaliation. They said agents locally and across the country are using a number of tactics to bypass this court settlement, including requiring touring agreements — without a commission listed — rather than buyer-broker agreements before showing homes. Agents said buyer’s agents are then using the mantra “open the door and charge them four,” with the buyer’s agent making a 4 percent commission. After showing the homes, the buyer’s agent then provides the buyer-broker contract, which has the agent commissions on it."

Agents will discount their commissions! Just ask! A new Zillow report finds that: " When working with a buyer, 75% of agents report that they offer a commission rebate or a discounted commission.

As we saw in our 2025 Consumer Housing Trends Report for Agents, buyers 49 and younger were more likely to receive a rebate than buyers 50 and over. Buyers in their 30s were most likely to successfully negotiate a rebate. Among those who used an agent, 28% received a rebate."

The deadline to file a claim in the commissions suit is past. Hopefully, they'll distribute payments soon to those of us ripped off. Supposedly, each seller could gain a little windfall of about $250.

Based on the number of claims filed by the May 9 deadline, each home seller could receive around $250 from the over $1 billion settlement fund.
