Be careful with attorney real estate advice during divorce!
We often have calls regarding what to do with the house in the event of divorce. Usually after the divorce is finalized and the couple has received poor attorney guidance.
Your mortgage lender doesn’t care about your divorce decree. If both spouses are on the note prior to divorce, they will remain on the note after divorce. Your options are to refinance under on spouse or sell the property and split proceeds/liabilities.
While attorneys should deal with this during the divorce negotiations, they often do not. Sometimes nasty surprises arise after. Don’t discover this surprise after, call me before you sign anything and let me guide you on the real estate end. Then you are prepared for the attorney discussions.
