Starting January 1, 2026, Illinois' new "Squatter Bill" (SB 1563) changes how squatters are handled, allowing police to remove them as criminal trespassers, bypassing the old, lengthy eviction process. This law clarifies that property owners can get squatters out quickly by proving ownership, as law enforcement can now act on criminal trespass, not just civil landlord-tenant issues, ending squatters' ability to exploit tenant protections to stay on properties they don't own. 

Key Changes Effective January 1, 2026:

Faster Removal: Police can remove unauthorized occupants (squatters) for criminal trespassing without the owner having to go through a lengthy court eviction.

Clearer Distinction: The law creates a clear separation between legitimate tenants and illegal squatters.

Empowered Law Enforcement: Officers have clear authority to act when an owner shows proof of ownership and trespassing is occurring.

Addresses a Loophole: It closes a loophole where squatters could claim tenancy rights to delay removal. 

Why the Change?

Prevents Exploitation: The previous system forced owners into a long eviction process even when squatters had no right to be there, notes Illinois REALTORSŽ.

Response to Incidents: The bill gained momentum after instances where squatters occupied homes and resisted removal, including a case involving a state representative. 

In Simple Terms:
If someone illegally moves into your vacant Illinois property on or after Jan 1, 2026, and you can prove you own it, police can remove them immediately for trespassing, rather than making you wait months for a court-ordered eviction.
