Delaware Transfer on Death Deed: What Homeowners Need to Know.

Delaware homeowners now have another estate-planning option for transferring real estate to loved ones without requiring that property to pass through probate.

🏡 Delaware Homeowners: Did You Know About the New Transfer on Death Deed?

Delaware homeowners now have another option for passing real estate to loved ones without the property having to go through probate.

In 2025, Delaware adopted the Transfer on Death Deed (TODD).

A Transfer on Death Deed allows a property owner to name one or more beneficiaries who will receive the property upon the owner’s death.

Some important things to know:

• You remain the owner and maintain control of your property during your lifetime.
• The beneficiary has no ownership interest while you are living.
• You can change or revoke the Transfer on Death Deed during your lifetime.
• You can still sell or mortgage the property.
• Upon your death, the property can transfer directly to the named beneficiary without going through probate.
• The TOD deed must be properly completed, witnessed, notarized and recorded before the owner’s death to be effective.
• Existing mortgages, liens and other encumbrances don’t disappear because of a TOD deed.

The law is statewide, but the deed is recorded in the county where the property is located.
