September 30, December 31, and September 30, 2027: Understanding the Upcoming EB-5 Deadlines

Several important EB-5 dates are approaching, but they do not all have the same meaning. In particular, there has been some confusion about whether the EB-5 Regional Center Program will end on September 30, 2026.

The short answer is no.

The Regional Center Program is currently authorized through September 30, 2027. September 30, 2026, is instead an important grandfathering deadline. The next major date is December 31, 2026, because the EB-5 minimum investment amounts are scheduled to be adjusted for inflation beginning January 1, 2027.

For investors who are already confident that they intend to pursue EB-5, the safest approach is to file before September 30, 2026, in order to receive the explicit grandfathering protection provided under the current law. However, EB-5 will remain available after September 30.

EB-5 Concurrent Filing & International Travel: What Investors Need to Know 🇺🇸
For eligible EB-5 investors already living in the United States, concurrent filing can offer important flexibility.

You may be able to file Form I-485 together with Form I-526E and also apply for employment authorization and advance parole while your case is pending.

But one point is especially important:

Filing Form I-485 does not automatically authorize international travel.

In many cases, leaving the U.S. while your I-485 is pending without approved advance parole can cause USCIS to treat the adjustment application as abandoned.

There are exceptions.

Qualifying H-1B and L-1 holders may generally have more flexibility to travel and return in valid H or L status without abandoning their pending I-485.

By contrast, applicants in classifications such as E-2, F-1, TN and O-1 generally do not have that same exception.

For E-2 investors transitioning to EB-5, this is particularly important:

A valid E-2 visa should not be treated as a substitute for advance parole once Form I-485 has been filed.

This becomes even more important if you are also:

• Selling your E-2 business
• Restructuring ownership
• Transitioning away from active management
• Investing business-sale proceeds into EB-5
• Timing an EB-5 filing around a major business transaction

Another common mistake: filing Form I-131 is not the same as having approved advance parole.
And even with approved advance parole, reentry is not guaranteed—CBP still makes the final inspection and parole determination at the port of entry.

Final Call!: Join the Cairnspring Mills Investor Site Tour — July 25

This Saturday, July 25, EB5 Visa Investors will host an exclusive investor site tour of Cairnspring Mills and the Blue Mountain Mill rural EB-5 project.

The visit will begin in Seattle and head to Cairnspring Mills’ current headquarters in Washington’s Skagit Valley, where participants will meet members of the company’s leadership team and gain a first-hand understanding of its operations, growth strategy, and position within the premium craft flour market.

From there, the group will travel to Pendleton, Oregon, for a guided visit to the Blue Mountain Mill project site, where construction is now in its final stretch.

The project is officially I-956F approved and has attracted significant investor interest. Only a very limited number of tour spaces remain.

We are pleased to announce that USCIS approved our Cairnspring Mills project I-956F without issuing any RFEs or NOIDs, approximately 4.5 months after filing and roughly one month after we filed our writ of mandamus. As the project has used bridge financing ahead of the EB-5 funds in order to ensure the project will remain on schedule for a construction completion and start of full operations by November of this year, the approval was especially encouraging in light of the language on bridge financing in the recently published DHS EB-5 notice of proposed rule making.

As a team, we've been proud to be a part of Cairnspring's expansion into Eastern Oregon, as we feel the project truly embodies the original intent of the EB-5 program, and especially the rural set aside created by the 2022 RIA, by helping to rebuild the American milling industry, bringing long term manufacturing jobs to underserved rural communities, and providing a viable alternative model for American grain farmers wanting to make the transition to regenerative farming.

A special thank you to our counsel Robert Divine and his team at Baker Donelson, as well as our business plan writer Suzanne Lazicki from Lucid Text, who were able to capture an especially creative project capital structure and scope in a very elegant and professional manner. Construction continues to advance at the Cairnspring Mills Blue Mountain Mill in Pendleton, Oregon, with another major milestone now underway.

In this July construction update, Head Miller Josh shares the latest progress from the job site as crews begin installing key milling equipment, including the wheat receiving mix bins. Interior firewalls are also nearing completion, and the project remains on track for an October commissioning and startup, meaning that revenue will be coming into the Blue Mountain mill by the end of the year.

These milestones represent the transition from structural construction to equipment installation and commissioning—a significant step toward bringing one of the largest premium craft flour mills in the Pacific Northwest into operation.

For EB-5 investors, the project combines the advantages of a rural TEA investment with an established operating business. Cairnspring's existing Washington mill is already operating at full capacity, while the new Blue Mountain facility is expected to expand production approximately 10-fold to meet growing demand for premium, identity-preserved flour. The project also benefits from substantial construction progress, an experienced management team, and long-term offtake agreements with nationally recognized customers.
