In California, a buyer must sign a legally binding representation agreement with their real estate agent before they can tour homes together:
New rules
As part of a national real estate settlement, buyers must sign a buyer's agreement to view properties with a realtor. This agreement is designed to:
Inform buyers how their agent gets paid
Make buyers responsible for paying the agent's commission if the seller doesn't
Make buyers aware that the commission is negotiable
Improve transparency for agents who don't use the MLS
New law
California also has a new law that limits buyer-agent contracts to three months. This law is intended to:
Improve transparency
Provide more structure in case there's no showing
Protect buyers and brokers from potential disputes, legal uncertainties, and conflicts of interest
