💰 Earnest money question I get all the time:
“If I cancel a contract, do I lose my earnest deposit?”

The answer is: it depends on the reason and the timing.

Most real estate contracts include contingencies, which are protections for the buyer. If one of these contingencies applies and you cancel within the allowed timeline, you can usually receive your earnest deposit back.

Some common examples include:

🔍 Home inspection contingency
If the inspection reveals issues and you decide not to move forward within the inspection deadline.

📉 Appraisal contingency
If the home appraises lower than the contract price and the parties can’t come to an agreement.

🏦 Financing / lending contingency
If your loan is not approved despite good faith efforts.

🏡 Title issues
If problems with ownership or liens are discovered.

📄 HOA document review (when applicable)
If you review HOA documents and decide the property is not a good fit.



However, if a buyer simply changes their mind — like finding a different home they like better — and none of the contractual contingencies apply, then the buyer may risk losing their earnest deposit.

That’s why deadlines and contract terms are extremely important. A good Realtor keeps track of those timelines to help protect your deposit.

🏡 Real estate question:
How many times can a buyer and seller counter back and forth on an offer?

Short answer: technically… as many times as you want.

I’ve seen contracts go back and forth more than 10 times. There’s no official limit in most situations — you can keep negotiating until one side accepts or walks away.

But here’s the part people don’t always realize 👇

After about the second or third counter, tension usually starts to build.
When negotiations drag on too long, it can create frustration on both sides. And when a deal starts with tension, the chances of it falling apart later (during inspections, repairs, etc.) often increase.

That’s why I typically recommend keeping counters focused and strategic. Most smooth transactions come together within one to three counters. It keeps communication clear and helps both sides feel good about moving forward.

Every deal is different, and sometimes more negotiation is necessary — but strong, thoughtful offers and clear expectations from the beginning usually lead to the best outcomes.

Did you know the State of New Mexico is holding Delinquent Property Tax Auctions in March 2026? 👀

That means properties where owners haven’t paid taxes for several years are being auctioned off by the state.

Here are the counties currently scheduled for March 2026:

📍 Harding – March 2
📍 Union – March 3
📍 Colfax – March 4–5
📍 Santa Fe – March 13
📍 Eddy – March 17
📍 Lea – March 18
📍 Otero – March 24

Now here’s the part that affects US locally 👇🏽

❗️As of right now, Curry County and Roosevelt County are NOT on the March schedule.

That does NOT mean they won’t have auctions in 2026 — it just means they are not currently scheduled for March.

These auctions are handled by the State of NM (not the county MLS), and properties are typically several years delinquent before they qualify.

⚠️ IMPORTANT:
Buying at a tax auction is NOT the same as buying a normal listing. There are risks, research requirements, and strict payment rules.

Even with a VA loan (or seller-paid closing costs), you still need some money ready before closing.

Here are the most common upfront costs buyers should expect 👇

🔹 Earnest Money Deposit (EMD)
This shows the seller you’re serious.
✔ It’s negotiable
✔ It goes toward your purchase at closing
✔ But you need it available upfront

🔹 Appraisal Fee
Usually paid upfront once you’re under contract.
Sometimes this can be negotiated or credited back at closing — but not always.

🔹 Home Inspection
Almost always paid by the buyer.
This is non-refundable and paid before closing.



Yes, sellers can sometimes help with closing costs 🤝
Yes, everything is negotiable.

But even when sellers help, you should still plan to have cash ready for:

🏡 Buyer tip of the day:
If you’re waiting to buy a home just to raise your credit score a little higher… this is something to think about.

A higher credit score can help your interest rate — yes.
But what many buyers don’t realize is that market timing can matter just as much (sometimes more).

Example 👇
Someone with excellent credit who buys when rates are higher could still end up with a higher monthly payment than someone with average credit who bought when rates were lower.

So while credit is important, waiting months (or years) just to gain a few points might not always be the best strategy.

Here’s the mindset I like to share with my buyers:
✔ Buy when you’re financially ready
✔ Buy when the payment makes sense for YOU
✔ If rates drop later, you can refinance
✔ If rates rise later, you’ll be glad you didn’t wait

And remember — those 3% interest rates from years ago were a rare moment in time. Today’s market is different, and trying to perfectly time everything can sometimes cause buyers to miss opportunities.

A lot of military buyers don’t realize this, but BAH (Basic Allowance for Housing) can often be used as qualifying income when applying for a VA loan 💡

Here’s the simple breakdown 👇

✅ BAH is considered stable income
Even though it’s non-taxable, many VA lenders can include it when calculating your buying power.

📊 It can help your debt-to-income ratio (DTI)
This can make a BIG difference in how much home you qualify for.

📄 What lenders usually need:
• Your LES
• Proof of consistent BAH
• Orders / duty station information

⚠️ Important to know:
Not all lenders treat BAH the same — how it’s calculated depends on the lender’s VA experience and your timeline (especially if a PCS is coming up).

🇺🇸🏡 VA Buyer Tip: When you close can affect when you make your FIRST payment.

Here’s a strategy I like to explain to my VA buyers because most people don’t know this 👀👇

⏰ Most lenders don’t require your first mortgage payment until about 30–60 days after closing.
That means your closing date matters.

📅 Example:
• Close at the end of January ➝ first payment is usually due in March
• Close in the first week of February ➝ first payment is often due in April

That’s a BIG difference in timing 😮

⚠️ Important clarification:
This doesn’t mean you’re skipping payments or doing anything shady.
✔️ Interest is still calculated daily
✔️ Prepaids/escrows are still accounted for
✔️ But in many cases, seller concessions can help cover those upfront costs

💡 The goal is to structure the timing in a way that benefits YOU, especially if you’re PCSing, moving, or trying to keep more cash on hand at the beginning.

This is something I wish I had known earlier — so now I make sure my buyers understand it before we write an offer 🤍
