🚨 New Ohio Law Takes Effect Today: What Sellers Need to Know About Wholesaling (SB155) -FINALLY 👏 ‼️
Here’s what that means in plain English:
👉 If someone wants to “buy” your home and they’re a wholesaler, they are now REQUIRED to give you a written disclosure before you sign a contract. That disclosure must clearly state that:
• They are a *wholesaler (Not a Realtor)
• They are *NOT* representing you
• They plan to assign (sell) the contract to another buyer for a *profit*
• You may be agreeing to sell your home for *below market value*
• You have the right to seek advice from a real estate professional or attorney
This disclosure must be signed by both parties before a binding contract can happen.
If a wholesaler fails to provide this disclosure:
✅ The seller can cancel the contract anytime before closing without penalty
✅ Any earnest money must be returned within 30 days
✅ Violations are considered an unfair or deceptive practice under Ohio law
This is a good start. But we still need more awareness and education for sellers — especially elderly homeowners and families going through probate which I do a lot of work with. They're the ones who are often targeted by these deceptive tactics. Sadly even their attorneys aren't aware many of the times.
