Tallahassee Investors Network’s mission is to develop, support and promote local real estate investing through networking, education, leadership, and promoting professionalism, ethics, and standards of excellence in our industry. We seek to provide:

• A forum for marketing investment properties and related products or services
• A promise to never, ever “

• Provide encouragement, moral support and collective experience to those in need.

A federal judge just handed landlords a win that nobody's talking about — and if you own rentals, you need to know about it. 🏠
For years, the script has been: tenant produces an ESA letter → landlord waives the pet fee. No questions. There's a whole online industry built around selling those letters specifically so people can skip animal fees.

Well… a judge in Louisiana just said not so fast.

In Henderson v. Five Properties LLC, the court ruled that a tenant asking for a pet fee waiver has to actually prove two things:
1️⃣ The waiver is necessary — meaning it's essential to dealing with their disability
2️⃣ The waiver is reasonable — looking at the size of the fee, what other tenants pay, the impact on the landlord, etc.

And here's the kicker — the judge looked at HUD's guidance (the stuff everyone's been treating like gospel) and said it's not persuasive. Courts interpret the law. Not agencies.

What this means for you as a housing provider:
✅ An ESA letter is not an automatic free pass
✅ You can evaluate requests case-by-case
✅ Alternatives like installment payments can count as reasonable accommodation
✅ The tenant carries the burden of proof — not you

This is the stuff that protects your portfolio. Knowing the difference between what an agency says and what the law actually requires is worth real money over the life of your rental business.
