As of this morning, Santa Clara County has 810 active condo and townhome listings, 321 pending sales, and 277 closings in the past 30 days. Overall, condo and townhome sales have been slower across the Bay Area. A number of factors are contributing to this trend:

Uncertainty around H1B visas and lengthy green card wait times – Many H1B visa holders are understandably stressed. For Indian and Chinese nationals, the green card process can now take over 15 years. Losing a job leaves just 60 days to secure a new one, or risk losing status and having to leave the country.

Ongoing layoffs – Recent job cut announcements from major Bay Area employers such as Cisco, Intel, Intuitive Surgical, and Oracle have created additional uncertainty for buyers.

SB 326 Balcony Law – California’s Senate Bill 326 requires condo HOAs (with three or more units) to conduct structural inspections of exterior elevated elements like balconies and decks. Lenders are increasingly requiring these reports before approving loans. Some HOAs are refusing to provide them, leading to denied loans. In many cases, inspections have uncovered significant damage and costly repair needs.

High HOA fees – The average HOA fee in the Bay Area now runs $500–$600 per month, with some communities charging even more. Buyers should note: a low HOA fee doesn’t necessarily mean good management. In fact, underfunded HOAs that defer critical maintenance can face even higher repair costs down the road.

High mortgage rates – Elevated mortgage rates continue to dampen homebuyer affordability and activity across all housing types.

Lingering COVID-era buyer preferences – Since the pandemic, more Bay Area buyers have gravitated toward single-family homes, valuing private space over shared community living.
That said, not all communities are impacted equally. Well-maintained properties with fewer repair needs continue to sell more quickly and perform better than others. My recommendation is to be proactive with the HOA to get the necessary inspections and repairs done.
