Here are two important questions companies that assist clients in recovering excess proceeds in Texas need to ask their clients . . .
People think that because their deceased loved one prepared a will, it governs. It does not.
Often they are not told that a will alone is not valid for transferring property unless it is taken to court after the loved one dies.
As an Excess Proceeds company, ask your clients, "Was the will approved in court?" If the answer is "no," then ask, "When did they die?"
If it has not been more than four years, it can be probated and approved.
