Have you been contacted by an out-of-state "realtor" or company promising a quick cash incentive or a "guaranteed" sale? STOP and read the fine print. 🛑

We are seeing a rise in predatory "Right to List" service agreements. These companies offer a small upfront payment (often $300–$1,000) in exchange for the exclusive right to list your home.

The Trap:
-Decades-Long Commitment: These contracts aren't for 6 months they can last up to 40 years.
-Hidden Liens: The company may record a memorandum against your property's title without your knowledge.
-The "Hostage" Fee: If you try to sell with a local agent, refinance, or even transfer the home to a family member, they may demand a percentage of your home's value just to release the contract.

Red Flags to Watch For:
-Out-of-State Pressure: They rarely meet in person and push for digital signatures immediately.
-"Free" Money: Any offer of cash today for a signature on a future listing is a major red flag.
-Non-Expiring Terms: Standard listing agreements have a clear end date. These do not.

🚨 Realtors: Big Changes Coming March 1, 2026! 🚨

Starting March 1, 2026, new FinCEN Residential Real Estate Rules go into effect nationwide to increase transparency and combat money laundering. While real estate agents are generally not responsible for filing these reports, this will definitely impact your upcoming closings.

What you need to know:
The Target: Non-financed (ALL CASH) transactions of residential property where the buyer is a LEGAL ENTITY (like an LLC, corporation, or partnership ) or TRUST. This does includes vacant land transfers if the intent is to build a 1-4 family home.

The Goal:
Identifying the "beneficial owners" behind these entities to prevent funds from being hidden in real estate.

Potential Impact:
Expect more detailed data collection from your clients and possible closing delays if information isn't provided early. If information is refused the closing cannot proceed.

Who Files?
The responsibility falls on a "reporting person" typically the settlement agent or title company. We ask that you prepare your customers from the beginning if they intend to purchase as an Entity or Trust.
