Ai is rapidly changing real estate marketing, but AI-edited listing photos are creating growing concerns within the local MLS. While traditional photo editing has long been accepted for brightness, color correction, and lens adjustments, newer AI tools can unintentionally alter the actual structure or condition of a property. These changes raise serious concerns about consumer trust, legal liability, and misrepresentation.
California recently became the first state to implement broad regulations addressing this issue through Assembly Bill 723 (AB 723), which takes effect in 2026. The law requires agents and brokers to disclose digitally altered listing photos and provide access to original, unedited versions. California MLS organizations including CRMLS, SDMLS, and Bay East have updated their MLS rules to comply with the legislation. The rules specifically identify edits involving walls, flooring, fixtures, landscaping, views, neighboring properties, and even floor plans as potentially misleading if not disclosed.
One of the biggest emerging problems is that AI editing software can accidentally change physical features during enhancement processes. AI-generated “cleanup” edits may move windows, widen hallways, remove staircases, alter door placement, or change room dimensions without the editor immediately noticing. Some virtual staging tools also unintentionally modify cabinetry, flooring materials, lighting fixtures, or exterior views. These alterations may create inaccurate impressions of layout, accessibility, or usable living space. Industry discussions among photographers and REALTORS® increasingly warn that these subtle modifications could expose agents to claims of false advertising or material misrepresentation.
