Amigos estamos en el 2023 no 2022 o 2021 los intereses de 2.8% o 3. y algo es muy improbable que ocurran en un futuro cercano, aunque les parezca caro los intereses en estos momentos están muy por debajo de la media de los últimos 30 años. The "as-is" clause in our residential purchase agreement seems to be so simple, and straightforward...

However, depending on the market at the time, it can mean a tough renegotiation between the parties. In an extremely hot market, a seller is obviously in the driver's seat, which means that most likely there are backup up offers in place.

In that case, a buyer may be hard pressed to forgo any requests for repairs and truly accept the property "as-is".

Controversially, in a slower market, a buyer's chances to get the seller to repair or give credits are much better.

Most sales we assist with, either on the buyer or the seller's side, do involve some sort of seller concessions, as a win/win is always a great way to move forward.

That is why proper counseling on both sides of the transaction is crucial in order to navigate through this potential deal killer.

One of the reasons that made Zillow, Trulia, and Realtor.com possible, is IDX.

You see, without data sharing agreements between the local MLS's and those large consumer oriented platforms, you wouldn't be able to search for properties on your own.

Not every agent welcomed IDX back in 2000; as a matter of fact, we still have the option today to "opt out" of sharing the information we as agents submit to our local MLS. But I believe that a restrictive and protective approach isn't what benefits us agents in the long run.

Our main benefit to our clients isn't as "keeper of information", but the knowledge and experience we bring to the table on how to apply the information to our clients' benefits.

Verá, sin acuerdos de intercambio de datos entre los MLS locales y esas grandes plataformas orientadas al consumidor, no podría buscar propiedades por su cuenta.

No todos los agentes dieron la bienvenida a IDX en 2000; de hecho, todavía tenemos la opción de "optar por no compartir" la información que, como agentes, enviamos a nuestro MLS local. Pero creo que un enfoque restrictivo y protector no es lo que nos beneficia a los agentes a largo plazo.

Let's take a look at what the Clear Cooperation Policy means for a listing:

When I take a listing, I am required to input the property into the MLS within 1 (one) business day after I start marketing the property publicly.

What is considered "public marketing"?

A "For Sale" sign in the yard, distribution of flyers, posts on Social Media and websites, email blasts, pitching the property at a local realtor association; generally anything that promotes the property to the public at large.

I do have the option to either put my listing into "coming soon" or into "active" status.

While the property is in "coming soon" status, no showings are allowed until the property is moved into the "active" category.

A property can remain in "coming soon" status for a maximum of 21 days.

I am not a fan of this policy! I believe that NAR, in their infinite wisdom, completely missed the mark on this one and have achieved exactly the opposite of what they wanted to achieve.

You see, unless the listing agent undertakes what is considered "public" marketing, he/she is still allowed to advertise the property to his/her own clients as well as within the their brokerage.

That creates a shadow inventory of listings within that brokerage which are only available to clients of that brokerage, but not to the general public.

Only giving a certain group of buyers access to a specific group of listings is exactly the opposite of what NAR claimed was their goal.

“Listados de bolsillo”... ¿Sí o no?

La respuesta corta es: No soy un fan, con una advertencia:

En mi opinión, los “listados de bolsillo” roban a numerosos compradores bien calificados sus posibilidades de poseer una propiedad.

Es muy frustrante para un comprador serio ver una y otra vez casas que aparecen como "vendidas" y que nunca se incluyeron en el MLS; esos compradores nunca tuvieron la oportunidad de ofertar y competir por estas casas.

Cuando represento a un vendedor, siempre aconsejo a mis clientes que NO sigan la ruta de un “listado de bolsillo”, pero si el vendedor es inflexible al respecto por razones de privacidad (consulte la advertencia mencionada anteriormente) y comprende la implicación que la falta de marketing podría tener en el precio de venta final, voy a cumplir.

Pero lo general, no creo que las “listas de bolsillo” sean el camino a seguir, los riesgos para un vendedor de vender su propiedad demasiado bajo son demasiado altos.
